Default Texas NFA trusts

I would be happy to help in what ever way I can. My main goal is to make sure that people understand what they are doing. I would like for nothing more than to find an easy simple way to have people create gun trusts and know how to use them without help. I can tell you that its not something most lawyers would even attempt and I am not sure why non-lawyers would take the risk.

David,

Looking over your summary regarding trusts led me to investigate further on your website and I must admit I'm impressed. Currently I have two items pending transfer with a Willmaker trust I created and lucky for me I went with the suggestions you listed during its creation. My question after looking over your information is, can my current trust be modified to add trustees but keep the assets in place avoiding a taxable transfer? If this is the case who would I speak to for help in Houston in adjusting the existing trust to better fit my needs?

Ive ran across David Goldman's seminar logs while searching the net prior to obtaining my NFA Trust. Hes helped out a lot of ppl overcome this silly hurdle.

We do have several Attorneys in Texas the create NFA trusts or trusts for the purpose of purchasing, acquiring, and using firearms restricted by the National Firearms act.

To create a Texas NFA trust give us a call and we will determine what you are trying to accomplish, what you need to protect against, draft the trust and forward it to the Texas Firearms Trust attorney who is best suited for your needs based upon geography, time frame, and other needs.

Once you receive the Firearms Trust, it will be reviewed, you will be taught how to use the trust, how to purchase the items correctly, and how to avoid the procedural violations of the National Firearms Act.

Start to finish is usually 3-7 business days and if you ever have questions about the use of the trust or proposed action there is no charge for answering questions.

We can also review trusts that you may have created on your own to see if there are problems and your trust and possession is in violation of the NFA. Just because you get the approval of the ATF with a returned Form 4 or Form 1 does not mean you are legally permitted to be in possession. We have reviewed many trusts that are invalid and until they were amended and resumitted to the ATF the possession was illegal and subjected the individuals to 10 years in jail and penalties of up to $250,000 per violation.

Gun Trust Lawyer put me in touch with the lawyer I used. It was worth every penny I spent having a trust done professionally.

He's right in saying that I wouldn't feel that the average lawyer, much less non-lawyer could complete the trust correctly.

When I asked my lawyer about the fee she said that NFA collecting and shooting is not cheap in any case. Check out the price of a FA UZI bolt conversion on Sturmgewehr, the Gunbroker of NFA weapons. THAT is expensive, not the price of the trust. Burning five hundred or a thousand rounds of 9mm WWB; ditto.

Your choice - and your felony conviction if you screw it up. Personally, I'll have it written by an attorney - it's cheap insurance, IMO. Besides - if that document IS copyrighted, and you're found out, you might find yourself with a document that's declared invalid at best! THEN what will you do?

Default Single or multiple trusts

What you are proposing can be dealt with in different ways. One is to create "mirror trusts" where each of you has their own trust but is authorized as a co-trustee on the other trust.

A second way it to create 1 trust and have everyone involved in the single trust. To determine what is best in your situation you need to look at what each of you wants to happen upon your death as well as how stable you feel your relationship is and if something was to happen between you, would one resign from the trust. Also there is the is the joint liability for all co-trustees. Its not just that they can use your firearms, but they are responsible for the actions of all other co-trustees under the partnership issues of the NFA

When I draft trusts for clients, I am leary of putting too many people on the tust as trustees. They all have access to the NFA weapons and at some point I'm worried that the ATF will start asking why there are so many trustees and why they all have access to NFA items.

Bascially, my thinking is that everyone has joint liability and a lack of accountability for the NFA items.

Like david said, you can create interlocking trusts for individuals.

You still have the potential issue of accountability spread over multiple households and multiple people over which you actually have little or no control.

What's the (prox) cost of the trust? I'm HOPING to get a Class III in the near future, and just trying to line up the various expenses ahead of time.
