    I’m not real sure this is a good outcome, since the facts leading up to the alleged assault aren’t mentioned.

    Second, I don’t really consider on off-duty cop, who’s allegedly being assaulted qualifies as good guy with a gun.

    Yay.
    I just hope to the heck it proves to be a justified shooting. Some detail missing, still.

    I’m not rushing to judgement on this one. Not enough information here. But troubled by the fact there was only one gun retrieved, the off duty cop’s gun.

    Surely, the “alleged” bad actor may have had another weapon, like a knife, but no info on it?

    And the “bad guy” had his family with him? Odd.

    This one seems to have more to it than a simple crackhead attack for cash.

    Deadly force can be justified against physical force only as long as it is reasonable to believe the physical force amounts to deadly force or attempted deadly force.

    On this I will have to disagree.
    What part of Texas law says I have to take a beating that could cripple or incapacitate me because someone doesn't intend to kill me?

    Of course we are talking about California.

    Cop is attacked shoots and kills his attacker and shoots two of the attackers family members is that the jist of the story?
    Hmmmmm, I read it as he shot 2 of his own family.


    EDIT: Ok. Went back and read for the umpteenth time. Yea it could be read as shot 2 of the attackers family members.

    An important aspect of justification for deadly force is disparity of force. Size, gender, number of attackers, weapons displayed, age, etc., all come into play.

    Based on the fact that the man who was shot was reported to have physically attacked the victim, since the attacker 2 additional family members were shot there does, at this point, appear to be a disparity of force at play.

    How old were the family members? Were they attacking as well. Anti-guns attacking what they thought was a licensed carry they did not agree with?
    Who knows.
    Attack me without a baby in my arms, depends on the situation. With a baby, for any reason, and I will shoot your dumb ass and anyone else I need to to protect that baby.
    Go to jail? Possibly.

    I just got thru reading the yahoo story. It didn't have a bunch of info. I suspect the off duty officer was probably recognized by the deceased. Words begin and supposedly the deceased assaulted him. I imagine his family members probably threatened the officer so they got a serving too. Officer had his kid in his arms so whacha gonna do?

    In my mind, off duty cop removes the good guy with a gun angle. Especially at anti-fun Costco.

    As for the rest of the story, typical journalism these days. Just a basic outline of what happened without the real story being told. Too many holes in the reporting, like always, so who really knows?
