    If you’re frustrated by poor service at a restaurant, think twice before you decide to not tip. You may be in for a bit more than just a dirty look from the waiter.
    "Nobody, nobody wants to be forced to pay a tip or be arrested for terrible service," Leslie Pope said when her happy hour ended in handcuffs.
    Pope and John Wagner were hauled away by police and charged with theft for not paying the mandatory 18 percent gratuity totaling $16 after eating at the Lehigh Pub in Bethlehem, Pa. with six friends.
    Pope claimed that they had to wait nearly an hour for their order and that she had to get napkins and silverware for the table herself.

    At this point I became very annoyed because I had already gone up to the bar myself to have my soda refilled because the waitress never came back,” Pope said.
    After the $73 bill came, the group paid for food, drinks, and tax but refused to pay the tip. After explaining the bad service to the bartender in charge, Pope claimed he took their money and called police. The couple was handcuffed and placed in the back of a police car.
    “I understand that, you know, we didn’t pay the gratuity, but it was a gratuity, it wasn’t something that was required,” said Wagner.
    The owner admitted that the group waited unusually long for their food, but said the pub was extremely busy that night. He said managers offered to comp the food, a claim the couple denies ever happened.
    “Obviously we would have liked for the patron and the establishment to have worked this out without getting the police involved,” said Deputy Police Commissioner Stuart Bedics.
    Police charged them with theft since the gratuity was part of the actual bill. However, it is doubtful that the charges will hold up in front of a judge. The couple is scheduled to appear in court next month.

    I don't pay for crappy service so that could have been me!
    Busy or not if the wait person is trying, even though slow I'll tip but if its a situation where other tables are getting good service and I am not, then no tip.

    I have been known to leave a single penny for poor service with a note that says poor service.

    I always tell the head waiter that if we are going to have a mandatory tip on the bill then I want 3 wait staff.

    A pal went to NY City to an electronic school required by his Texas employer and the group ate at some NY restaurant where the service was terrible, they left no tip and the waiter followed them out to the sidewalk
    yelling for his tip....They told him to go to hell....

    I have been told that 15% is customary, we try to always tip and sometimes exceed that figure when the food, service, (or beauty and smile) of the waitress rather impresses us....

    I've eaten at places where the service was fantastic and tipped upto the amount paid for the meal. Because of my work, often times we get discounts at local eateries, I always go in expecting to pay the full amount, if I get a discount I usually leave the amount I expected to pay for the waiter or waitress.

    If I get shitty service, I will absolutely complain and not tip. IF its the food is not cooked right I talk to the waiter or waitress and their tip then becomes contingent on how they try to help resolve the issue with the food.

    It's not uncommon for me to leave a 30% tip at places I frequent often because they always take care of me....and I will do this when ever I get great service!

    This is not a standard case of not tipping if this is the case; The restaurant had a policy of an added gratuity of a certain percentage with a party of so many people. I have seen this on menus before.

    Since they ordered they agreed to that fee. At that point, refusing to pay it is just like refusing to pay for the meal. Here we call it theft of service.

    In this case I have to agree with TXInvestigator. My wife and I tip very well when we go out (and even better when we bring the kids) if get good service. But with bad service I tend to either not tip or leave a very small tip. Usually speaking with the manager during the meal will offer a quick solution to bad service. For example, my parents flew out to visit us last year and we all went out to eat at a Chili's. There were 8 of us at in the party, so yes, there was an automatic 15% gratuity added to the bill. Long story short, we get a waiter who claims he loves working big tables, and then spends the next hour and a half hanging out at tables with friends and not serving us hardly at all. The manager came by just to do the whole "How is everything tonight?" spiel and we let him know. They comped the meal, gave us vouchers for 8 future kids meals (read as 2 trips) and we got two waiters from that point on. Now, for us, this had a good ending and we tipped well ( the new waiters and manager, not the original waiter as he was promptly sent home), but even if we hadn't received better service, I still would've paid because it's in the agreement that with parties of 6 or more it's mandatory. I don't have to like it, but it's there (and unfortunately when we go out it's always a party of 6 or more since we have four kids and a MIL and 2 BILS'S who like to go with us). Find a manager and let them know what's going on. If they won't fix the situation, don't return and/or complain to corporate, but it's not worth the hassle and possibly legal-battle to show your dissatisfaction by not fully paying your bill.

    I would call it theft of money, Much like Obama, forcing people to pay for something they did not get. In this case it would be good service, in Obamas case it would be a good president or the honest and transparent government he SWORE would come.

    Not only would I fight this in court, but weather I won the case or not. Not only would I never eat there again. I would never eat in that city again, or spend a penny there if I could help it.

    Is that a city law or a Pennsylvania law about the 18% gratuity. If that's a state law, then why in this universe would anyone live in PA???? That is complete and utter !!!

    I don't go by any set rate, but what is commensurate with service. If service is abysmal, they get nothing. BTW, I love that scene in Reservoir Dogs where they have that heated discussion about tips...awesome!

Not only was I a resident of the God-awful state, but I still have to spend 2/3 of the year in Ventura County. I have four kids, so when we take them out we have almost always had to pay that fee. The point is, once it's on the bill, you have to pay it.

    It's no different than if you get a phone bill that is uber high and you want to dispute the cost. By law you are still required to pay the bill until the matter is settled or they can charge you more in late fees, etc. After it is settled, they may reimburse, but a bill is a bill

    Wow, I must have fallen through the cracks or otherwise been lucky, because I've never encountered a mandatory gratuity or at least been charged for one. Trust me, I always look over my bill and I'd go ballistic if charged for that. Thank goodness this thread has opened my eyes to that practice...going to make sure to look or ask when I go to restaurants from now one. Again, that's B.S. of the highest order.

    BTW, do you recall which restaurants you've encountered that fee?

    If you are going to court invite the press. There will be a local paper, radio, talk show, or reporter that is bored. Even if you lose and have to pay the tip, you can cost that establishment more. Their reputation will suffer if only 20% of the people reached by media agree with you and I doubt the press coverage will coax people to eat there. Have fun with it.

    i say if they did pay the tip, the folks that ordered would be the ones robbed of service.

    and as for the single penny, i was once at a chinese restuarant that i got literally no service other than my inital beverage and my food. not even so much as a sideways glance from the waitstaff. fortunatly, my fortune cooki had a chinese style verion of a penny saved is a penny earned (i cant remember the wording but it was pretty funny) so i left the penny ontop of the fortune hehe.
