It may not be that much of a stretch. It's on school grounds. They have paid staff there. They monitor and check out kids. It's a scheduled time slot.

    What would disqualify it?
i drop my kids off on the way to work, and never even get out of my vehicles? I drop off my daughter at Menger. I pull up on the Alemeda side and she jumps out and runs inside. I have had a firearm with me 100% of the time.

    How old are your kids?

We goto private school, so I have a diff take.

Wife drops them off at early daycare, so she gets out and takes them inside A school building, so obviously, a no go

I pick them up after school, and they have teachers walk the kids to the car. So obviously a school function. Gun is in truck so no worries. But sometimes I forgo the pick up line, but still stand outside of school, and teacher calls for kid, another no-go IMO

Is the daycare in an actual school? Other than that, if it's a private daycare, it's probably NOT a school.

9 and 2. My daughter goes to public school. I have never carried inside the school, but dropping off and picking up carrying every time. Private school would be nice, but at this point we cannot afford $700 a month for it.

A lot of public schools have a daycare early and late.

They are wrong about the federal part, right? I thought federal law made an exception for licensed carry, but of course state law has it as illegal :(

Yes, the daycare is in a school building vs private daycare facility.

Are there teachers outside waiting for the students?

When you pick up, are the teachers aiding the kids?

If so I would consider that a school event

I agree w Tony, this guy has a history w LE and the school, that's why the special attention

My daughter is on safety patrol so she gets there before there are teachers outside , but otherwise yes. I will continue to carry in my vehicle and they can eat a bag of dicks.

The Federal law in question is a near carbon copy of a previous Federal law that was ruled unconstitutional.

They added a fig leaf of "having moved in interstate commerce" to the gun being carried in the vicinity of a school to address any future legal challenges. As far as I can tell, it hasn't been challenged since the original one was struck down.

I looked this dude up on fb and all of his posts are about OC and pictures of him open carrying. looks like he is extremely excited to show off his firearm to the public. I can see how he would get himself into trouble.. unfortunately he is making all gun owners look bad and definitely isn't helping the cause. its one thing to open carry, but its another thing when you go showing it off.

Is 'pickup time' and 'drop-off time' considered to be a "school activity"?

    --
According to the linked news report (Post #12 @ 0:57), the Texas AG has apparently made it known that Independent School Districts (ISDs) can define for themselves what a "school activity" is.
And per the published letter from the CCISD, they apparently have 'flowed down' the ability for each individual school campus (i.e., campus principals) to make that decision... so it may not even have a uniform definition within an ISD.
Is that the way you guys read it?

From the videos I saw he had a sit down with school officials and police to discuss concerns stated he likely would not open carry but made no promises. The next day while picking up his son the officer hassled him asked if he was concealed carrying at which he did not answer directly but that he had in the past. He was asked to leave the grounds and go to the sidewalk and his son would be brought out to him there.
