    The police stopped by here about ten minutes ago asking about a Ruger SR9c I pawned a year or two ago. All they would tell me is it was found at a crime scene. TG I remembered where I sold it and the business will have records!! It pisses me off that some A-hole douche bag could have caused me some serious problems!!

    why do you need a paper trail of where the gun went ?

    All you say is it was sold. They look at the evidence and see you are not a criminal and was no where near where the crime was committed when it happened.

    Yes, they can take my word that I sold the gun. However, I might not have an alibi if they have no other leads and pursue investigation against me because I live alone in a rural area. I have no criminal record but many crimes are committed by people with no prior convictions.

    I bought the pistol new at Academy Sports and the police had record of that. BTW, I've also sold guns to individuals who I trust. I won't be doing that ever again without a signed sales receipt.

    The police know it went to Academy because that's where the manufacturer shipped it. They ask Academy to pull the 4473 which leads them to the first purchaser. With no further paperwork, that's where the trail ends.

    The pawn shop didn't have to fill out a 4473 when they resold it?

    I'm sure they did and this is what will assure the police don't bother me again. Pawn Shops are required to do a NICS check even if the original owner retrieves the firearm from pawn and even if it's the same day it's pawned.

    Thats my fear actually. I have two shelves of broken or otherwise no longer desired pistols that I won't sell or give away. Legal issues but also the thought they could be used in a crime would make me feel responsible.
    Why would you be responsible for the actions of another person? Unless you somehow forced them to commit a crime.

    If I'm understanding correctly, the police traced the firearm to you. You led them to the pawnshop where you sold it and they'll go from there. Sounds like it's a good thing you went to a pawnshop in this instance because they'll have proof you sold the firearm. Lets you off the hook.

    Gunz are icky.
    If you sell the firearm to a legit FFL dealer they are supposed to log in the sale.
    They should 4473 the gun when it is later sold.

    That's my point precisely. And is exactly why I'll never sell a firearm without ID and a signed receipt ever again. I've sold several guns to individuals who I knew/know and trusted/trust but there's no assurance they'll never commit a crime with them and if someone does, they may deny they bought it from me. I can't even remember which firearms went to whom. Plus, I know for a fact most of them were sold again to other people who I don't know. Since I bought all of mine (both new and used) through retail stores or through FFLs any crimes committed with those firearms will come back to me.

    Been there done that. Got a call from Police wanting to return a gun I had traded at a gun show 10 years before. All they said was the legal proceedings were all over and did I want to come pick it up. I have this honest streak that made me tell them it wasn't mine. They withdrew the offer. Everybody was nice.
    Got a visit from a Sheriff's deputy from nowhere near me. Wanted to arrest me for robbing a convenience store. They got me from the plates on my truck where it crashed in a ditch. I had traded it in a year before. Seems the dealership failed to change the title when they sold it. I had a paper trail on the truck that saved me a night in jail. My uncle sold a car and was arrested the next morning for robbing a bank. He did a morning in jail before they worked it out.

    That's assuming that the evidence actually shows you weren't there, and that you have an alibi. That is not always the case unfortunately.

    SOME kind of paper trail is a good idea. Even just the person's name and the date you sold the gun is better than telling them "I sold the gun to some dude awhile back".

    I have a M1895 Nagant that won't shoot worth a damn with anything but surplus ammo, and even then it's not that great. I won't sell it because I don't want to burden someone else with it. I got it back when they were $100, so not a big loss. I'm just going to keep it for its history.
