Actually, it isn’t the only recourse, as the guard was arrested and criminally charged, which I’m guessing will be successful.

I expect LEO not to “suffer emotional and psychological distress” as a result of a threatening but non-violent encounter with a civilian that resulted in an arrest and criminal charges, especially one in which the LEO participated in the arrest.

I smell opportunism.

I say good for the deputy. Neither of the IRS offices here will allow you to carry inside their offices with a gun and a badge. Not sure about the uniform part. They also don't have lockboxes to lock up your gun. They do have armed contract security (Paragon) and you can imagine why. Complete over reaction by the guard and the person who called 911. It's like the recent Starbucks incident in AZ only worse.

He has every legal reason to sue, opportunism or not (don't know about the wife). In an age where civilians sue cops for everything imaginable, it is about time we reverse that. Screw the guard, screw the caller, and screw the IRS.

I pretty much agree with everything you said.

He is taking advantage of the situation.

Besides the fact that he was taking care of personal business while on duty. I don't really have an issue with that but it created this whole situation.

I think the guard overreacted but ultimately was in the right here. He did his job. He couldn't have known if the badge and uniform were fake so he took appropriate action.

He should have been the one to call 911 though.

It might be a news flash to people but LEOS don't have the right to carry firearms anywhere they want. There are areas and jurisdictions they are restricted from carrying. This Security Guard may have been a little Rambo, but he may have been initially in the right asking the officer to remove his weapon. To be fair, that cop could have just gone back to his car and removed his weapon and this never would have escalated.

Did the guard react badly? Yes, but the cop didn't help either.
