If we start protests anywhere, it should be in three places....the Mayor's residence, the Police Chief's residence, and the DA's residence. Let them know that they can be held accountable.....wherever they are.

You don't have the right views to get away with such protests. The FBI is actively seeking protestors at the capitol on Jan. 6th, at the same time protestors that assault federal officers in Portland are being released.

So it appear it was not an actual gun, but a stun gun.

And of course the White Guy has been charged. No charges for any of the illegal protestors.

That’s too convenient... and some screenshots look a tad different. Plausible deniability, I guess. Points for the genius that had that toy with him, even if he’s on the wrong side. Gotta Google pepper ball launchers now. “No officer, I didn’t threaten deadly force, it was a pepper ball launcher.”

So,,,,according to the police you can't assault someone with an "electronic control device"?
    That is pure unadulterated bullshit.

If pointing a taser at someone is not a credible assault, neither is pointing a gun by the same logic.

The entire video isn't shown. That officer was likely waiting on backup to arrive. I highly doubt you have a major intersection shut down and dispatch sends one officer and he is too ignorant to request backup. That officer did right by waiting on the median until more resources arrive to deal with dozens of protesters. As far as I can see there wasn't any immediate threat for him to deal with, just the roadway being blocked by protesters and the irate driver. On top of that now he has to deal with a disturbance. Roadways get blocked everyday on accident scenes and you just have to deal with it until the road is cleared, this is no different.
So the guy pulling out the pistol, even if a stun gun, and pointing it at the angry white motorist was not an immediate threat? Looking at it from where the cop was standing, no way he would immediately no it was a stun gun. maybe he did nit see it though but that most certainly was an immediate threat.

I'm talking here only about a fake or toy gun or object you insinuate is a gun not about any particular incident as the variables of real life may effect the legal outcome. And I'm not a lawyer.

    That said....
Technically, if you point anything like that, fake or not its legally considered a real gun aka ADW.

So you you are threatening deadly force and if they decide to respond with deadly force of their own they are justified and you just brought a pepper ball gun to a real gun fight.

Same goes for your finger in your coat pocket or a gun shaped wood carving. If you're insinuating you have a real gun while threatening with it you may just win the grand prize.

I have to agree with @candcallen on this. There are way too many airsoft, and toy guns that look very close to real guns. In a split second, how do you perceive a possible threat, and determine whether the person threatening you has a real gun, or a toy gun?

How many LE officers over the years, have been confronted with that same scenario, and afterwards, come to find out the person was unarmed, but had a toy gun instead.

It's just utter stupidity to pull a toy gun on a LE officer, and stupidity to do the same in state where people carry concealed or openly for self defense.

I didn't realize anyone pulled out anything until people started commenting on it. The plano chief even stated the officer on scene didn't see it. We have the luxury of being able to analyze the video multiple times.

Once we file the charge it's up to the DA to do their thing. The DA dropped most of the charges and she assured the chief they would prosecute everything. I know I made at least 5 good arrests and made a pistol case on a chick that was carrying a derringer in her bra and pointed it a reporter and her photographer.
