    Why was there a need to test fire the gun? It wasn't fired in the alleged crime, so it isn't like they needed to verify ballistics or anything. Is it so they could confirm whether it fit their definition of a lethal weapon, which it did not in the received condition, thus making the determination?

    Sounds like evidence tampering to me, but I'm not a lawyer.

    I’d read where the noisy cricket was inoperable at the time they brandished them that day but the rifle wasn’t loaded? Are you sure about that?

    I can’t imagine a scenario where I would pull out a firearm to defend myself that’s NOT LOADED?

    Well, one of the guns was evidently inoperable.
    I can't imagine I would do that either.
    I would have stayed in my house.

    Supposedly they were headed somewhere else when they came out with guns, no?

    They are both liberal attorneys......if they would have had a side by side double barrel shotgun........they would have just racked the slide hoping the noise of the action would be effective. rotflmfao

    From what I have read, the pistol was intentionally made "inoperable" by the lawyers to use in a previous case they had at trial. They used the gun as a prop for their case, so it probably had to be made inoperable in order to bring the pistol into the courtroom. That was documented by court records. That is how they know that the evidence lab had tampered with the pistol.

    Evidence tampering ,is bad news, regardless of whether you are the prosecutor, or the defense.

    Perhaps it was for demo purposes and not evidence.

    I think Oldag hit it on the button. Evidence is tagged with paperwork, and usually bagged. To my understanding, evidence has to be in the same condition as when it was found at the crime scene. The paperwork includes a chain of custody, that denotes exactly what people have handled the evidence, and exactly what procedures were performed to the evidence, and by whom it was performed. It is not to be altered, except under certain conditions.. Any alterations have to be documented, the reason, and by whom it was altered.

    I'm a bit conflicted on this. He states he supports the 2nd Amendment, feels he did the right thing in defending his home, but he took a plea deal to misdemeanor charges. Part of me says he caved to pressure, instead of fighting all the charges. Part of me does understand he probably just wanted to get it over with and was tired of the publicity.
