    I think..now that i look...travelling is NOT you driving....the "Actor" is the host and you are able to carry but not possess because you rented the gun at the range

    Shit....well felons...leave your shit at the house....use someone elses car AND gun....you'll be good

    This is great...so,
    46.02 says you are unlawfully carrying a weapon if prohibited by law from possessing a firearm

    then..in 46.04

    UNLAWFUL POSSESSION OF FIREARM
    (a) A person who has been convicted of a felony commits an offense if he possesses a firearm
    after the period of 5 years at any location other than the premises at which the person lives.

    46.15(b) then says
    Section 46.02 does not apply to a person who:(1) is in the actual discharge of official duties as a member of the armed forces or state military forces as defined by Section 431.001, Government Code, or as a guard employed by a penal institution;(2) is traveling;(3) is engaging in lawful hunting, fishing, or other sporting activity on the immediate premises where the activity is conducted, or is en route between the premises and the actor's residence or motor vehicle, if the weapon is a type commonly used in the activity

    So at this point...you can carry...but not possess.

    To be "carrying" the weapon doesn't have to be on your person but just in your area of immediate control.

    Nope, even holding a rented gun at a range is considered "possession".

    I am from Louisiana, and travel to Texas frequently and will be moving to Dallas in August. I read the first post in this thread about the carrying a firearm in the vehicle, but I would like to make certain I read it correctly. For the act of carrying not to be illegal, I need to be a resident of the state of Texas and must have the firearm (S&W Sigma 9mm as my truck gun) concealed. Is this correct, and does the firearm need to be a particular distance away from the driving location? In Louisiana, we can have the gun loaded sitting in the passenger seat if we feel like it. Before I carry one in my vehicle in Texas, I would like to know the law completely.

    No need to be a Texan, you just need to be able to legally own the handgun, and it be concealed.
    No distance requirements at all - just concealed. Got it in a shoulder holster under a loose shirt? Legal while in a motor vehicle if you don't have a CHL.

    Going forward, I think that's a very bad thing to do.
    You're gonna want to know the actual law, and wordings and such in the event you are ever stopped and find yourself dealing with an LEO who isn't familiar enough with the appropriate laws.
    "The guys on Texas Gun Talk told me I could" isn't going to get you anything but trouble, in such a situation.
    However if you know the law and explain it well, are cooperative and polite, and ask him to radio a supervisor or something - it could mean the difference between an inconvenient fifteen minute traffic stop, and a "less than pleasant" evening down at your local PD in handcuffs.

    lalonguecarabine, I completely understand what you are saying. However, Many laws are slightly difficult to read or understand. And thats not even discussing the interpretation of the law itself. I read the law from the link that was posted in the first post in this thread. While much simpler than other version of the same law I have read, it still had some grey area in the understand. With the simpler understandings nalioth, I have better interpretation of this law. I definitely agree that knowing the law is a very important part of being a citizen, and can help us not have problems/misunderstandings in the future.

    Mr 1911, a felon in Texas may not posses a firearm for 5 years after conviction, and possession includes carry. That includes your house and car, as well as someone elses house and car.

    After 5 years in your residence you may posses. But no where else. Everything you posted you are mistaken on.

    unfortunatley that is a dead link.
    i am still trying to figure out if i can carry a pistol in my car with no permit or not.
    in new mexico and colorado a car is considered an extension of my home.

    Here in Texas you MAY be able to do so. Keep the handgun concealed, do not commit a crime above a minor traffic offense, be able to lawfully posses a firearm, and do not be a member of a crminal street gang. Do all of that and you are good to go.

    Hi All-
    New to the forum and to the state of Texas.

    Could someone please shed some light on transporting a pistol while on bicycle? From what I understand PC §46.02 has rules for motor vehicles and PC §46.15(b)2 has to do with non-applicability of 46.02. Maybe this is obvious, but reading laws gives me a big fat headache.

    My question is (and I'm not yet a resident or a CHL holder) am I in accordance with the law by carrying a pistol (loaded or unloaded) in a backpack while riding a bicycle? Or would I need a CHL to do that? Does it make a difference if the pistol is in a bag attached to the bicycle, not me?

    I guess I'm getting confused because the pistol must be concealed in a vehicle, but if I'm outside of a vehicle and i conceal it (assuming i'm not going to my property or sporting event) then I'm violating law.. right?

    Does the non-applicability simply mean that there are no specific rules governing transport on a bicycle so long as I'm not doing something 1) I'd need a CHL for and 2) open carrying?

    Help is appreciated. Thanks in advance!
