    There is no legal requirement other than it is your responsibility to not sell to someone who is obviously not legally eligible to buy a gun. Under age, a felon (wearing hand cuffs) out of state plates... you get the idea.

    I always make one out for my own records, and for the buyers records.
    I'll be happy to email you a copy of what I use.

    FTF I write a bill of sale with ser. # and get their driver's license number. If they don't agree, no sale. Recently I have sold to FFLs at gun shows. Same deal. No paperwork, no sale. It's minimal self protection but not technically required by state or federal law.

    But it's legally required to not knowingly sell to someone prohibited from buying a firearm. If it's a stranger, you can ask and take their word, or actually make an effort, however little it is.

    Is a (wo)man's word not worth anything any more?

    Unfortunately, no, not strangers.

    Well, I keep playing devil's advocate because I see a disturbing (to me) trend in some of you to "let the government handle it" instead of taking a persons word.

    More like, it's against the law to sell to someone that is out of state. There's nothing wrong with checking an ID. It's no different than a bar checking my ID because I look young. There's nothing wrong with that, they have everything to risk if they simply take my word for it.

    "Did you know that the MAC 10 pistol you sold at the Astrohall gun show in August was purchased by an out of state resident, under 21 years of age? Did he show any ID? Did you ask his age? Can you show anything IN WRITING"

    The wording, more or less, of an unpleasant phone conversation to a friend about five years ago from a BATF agent.

    It is VERY different.

    Bars are licensed by the TABC.

    You are not. Legally, the individual telling you he's a Texan and not a felon is just fine.


    What's to risk? They say you told him you were a non-felonious Texan. If necessary, they can depose the same thing under oath.

    But I have to say, I've yet to see anyone want to "let the government handle it". Without 1, you can't have 2 so I don't see a trend. :p

    "Letting the government handle it" = issuing a drivers license / state ID, 'cuz you know, only the State of Texas knows if you're a resident or not.


    When every man is a liar until he shows his government ID, it's a sad, sad, world.

    I know they haven't put anything forward, but. . . .. When they say "gun show Loophole," I hear private transactions.

    I do the same thing, it's only smart and responsib;e. If they don't like too bad, somebody else can buy it.
