    I'm an avid Jeeper and go wheeling often and can't imagine running into something like that, but one more reason, my gun will be with me. I feel dearly for that family....

    These kind of acts coupled with signs that read"Trespassers will be shot. Survivors will be re-shot!! Smile I will." just makes all gun owner out as nuts.
    Secondly, you just don't start shooting until you know what's going on.
    Am I threatened, is my property being damage, who's there, ect...???
    Just based on that limited info I suspect the charge will be changed to murder and if there was no threat then murder is the correct charge - IMO.
    Man I hate to see this kind of stuff going on.

    I'm guessing there was more to it than anyone is saying. These morons can't be THAT stupid, can they? I suspect there was a meth lab or a secret crop these folks were getting dangerously close to.

    It's so sad for the little boy and the family. Ultimately, the anti-gunners will take this story and run with it... even though the problem is the nut behind the gun. This was neither a handgun, nor an "assault weapon". See! Americans can't be trusted with guns.

    I shake my head with disgust.

    Yea buy the picture and the suposed age they show a major sign of drug use most likley meth its one of the worse on your age. We have a major problem with meth around here its really sad.

    You are right about the "most unfortunate part" but I am with txinvestigator on this one. I'm not sure what details you're waiting on, but so far what has been released hasn't even indicated they were on the shooter's property, rather that were thought to be by the shooter. I can't even think of a set of circumstances that could come to light (short of the father and kids having guns and taking the first shots) that would make this be justified/excusable/even remotely ok.

    I am usually in your camp and wish to not pass judgement. I even had issue with the Joe Horn shooting, but according to the law he was dancing around that line and no matter which side of it he was on, he was no-billed. These two are well past the line with guns blazing. I know huge differences in scenarios, but you have to look at the laws and the actions. Joe Horn was close enough to getting it right for a Grand Jury. These two, I can't even imagine how they could be within the law.

    I am a red neck these are dope heads there is a difference. Red neck's are hard working and have a sun burn permanently on the back of there neck. Dope heads look like... well them. I hate to see a person get killed over stupid shit. My computer at work wont load the web page, how old was he?

    The boy who died was 7, his father was wounded in the shoulder, his 5yo sister was wounded in the elbow, and a 30yo family friend is in critical condition with a head wound. According to the Chronicle story, they were not on the shooter's property. Both individuals fired at least one shot apiece according to the story so they will both be on the hook for this one as well they should be. Hope that is a decent enough summary for you Big country.

    Don't get me wrong. I know what y'all are saying and you're probably right but having been on two different juries I know sometimes what seems to be the facts publicly aren't necessarily so.

    As to their looks they sure look older than their years and are ugly but ugly alone isn't justification for judging them.

    I'll bet there are some of us that wouldn't look so good in a mug shot especially if we're portrayed as gun toting crazies. It's obvious nobody photoshopped their photos.

    Is deadly force justified to prevent or stop trespassing?

    Depending on the circumstances and whether or not a felony is being committed or if you felt that your life was in danger yes, it can be justified.

    That is what I thought. Texas makes NO justification for using deadly force if "a felony is being committed", or if you "felt your life was in danger".

    And I ask you again, is deadly force justified to prevent or stop a trespassing?

    It's a great summary Thanks. And with what I now know they should both be prosecuted for murder. I feel the killing of a child constituents torcher and hanging, and furthermore I'll volunteer to kick the stool.
