    I didn't know were to post this so I stuck it hear. If I buy a gun from an individual and carry it for work and (God forbid) get forced to use it. Would I need some sort of bill of sale to get it back from the police dept? I want to buy new but if I buy one from an individual and can't prove ownership how would I get my gun back?:1zhelp:

    For duty carry I would either buy new,or used from a reputable gun shop.

    If you are buying from an individual you know get a bill of sale.

    Just my opinion.

    Just to add, get the serial number and have it run by local PD to be sure the gun is clean before buying.

    If I knew the gun was clean and had a bill of sale, I'd have no worries!

    I know the gun is clean he bought from either gt's or McBride's, one of the two. I just don't know if a bill of sale written and signed by two individual parties is legal enough to get it back from the DA's around these parts.

    I'm thinking that if the gun was bought legally... that is by the person you will buy it from and it wasn't stolen property, and you and the seller are legal to buy and own guns, then its clean deal and within the laws of our fine state. Shouldn't make any difference if your gun was purchased in this way, or new from an FFL. It's still legally yours. I always do a written BOS. I know some people object to that, calling in self imposed gun control, as a written BOS is not a requirement. I just feel better with something in writing, and have never had anyone object. It's good for both seller and buyer.

    You will not need a Bill of Sale to reclaim a firearm from the police. They will have the case number, you, and the serial number of the gun all tied together.

    People reclaim all sorts of property from the police with no bill of sale, all of the time.

    That's the first thing the detective in homicide is going to ask for is proof it's your gun.


    The "proof" will be your IDentification that matches you in the police report and property tag with the serial number number of that particular gun; the same one that was taken from you and recorded with your name, DOB, DL number, etc.

    No bill of sale or other "proof" of ownership is required.

    That is why I wanted to check and see if a BOS is good enough.

    A Bill of sale is meaningless. You could have sold the gun to someone else or given it to someone else without a bill of sale.

    When the police take property from you they make a property tag (report) that includes your name, DOB, DL number, address and other identifying information. The gun is also identified by serial number. That same information goes into the police offense report.

    To reclaim your property you must simply prove who you are. The reports will establish the property was taken from you.
