    Going to a new church and it is held at a middle school on school grounds. Am I okay to carry?

    I believe school being in session is what changes the rules on that but I would like to hear from someone in the know also.

    Same here ... I would THINK, but that only leads me to trouble and I wouldn't want him finding out the hard way either.

    There is no provision in the law for the current use of the building. The phrase is "the physical premises of a school or educational institution" where premises basically means a building but nothing "outside" or just covered. Neither "school" nor "educational institution" are defined in that section as I can find, though I thought I had a vague memory of finding one. HB2381 from 83(r) demonstrates that legislators appear to believe that the prohibition from carrying currently applies regardless of when classes are in session.

    I don't think it's been tested in court. Personally, I would not carry in any building that could reasonably be called a school, regardless of class being in session.

    Nothing is in session. The church and its members are using the schools building.

    Thanks TXI. I sure hope that any American Jihad Terrorists do not find out that there is a large group of law abiding Christians meeting every Sunday unable to defend themselves being on school grounds.

    So what does this part specify:

    ***SECTION*2.**Section 46.03, Penal Code, is amended by*amending Subsections (a) and (f) and adding Subsection (f-1) to*read as follows:********(a)**A person commits an offense if the person intentionally,*knowingly, or recklessly possesses or goes with a firearm, illegal*knife, club, or prohibited weapon listed in Section 46.05(a):**************(1)**unless pursuant to written regulations or written*authorization of a school or educational institution, regardless of*whether the school or educational institution is public or private,*on:********************(A)**the [physical] premises of*the*[a] school or*educational institution*on a day when classes are in session and*students are present;


    Is that just clarifying something else or what? I read it as you can't carry when class is in session and students are present. I also read it as you can carry on those premises when those criteria are not met (like church on Sunday). What am I missing or does another law supersede this?
