    Although most news channels are covering the story as the family being victims already, as I agree.

    You would only need to shoot one. The guy who started after the window with his helmet; one to the face would have had em scattering.

    If they were truly outlaw bikers everyone in the RR would be dead. I think most of the bikers were weekend posers. So I agree, unlikely any of the bikers would get involved in someone else's fight. But never underestimate the power of stupid people in large groups.

    Enough to charge you with illegally discharging a firearm, yeah. Warning shots get you jail time.


    Prosecution for showing a mob a gun in order to disperse the threat or a warning shot to accomplish the same thing just makes no sense to me.

    Can anyone explain the reasoning behind that?

    I seem to recall a gun owner in Mesquite being charged (not sure about actual prosecution) with unlawful discharge after he fired a shot into the ground while a couple folks were trying to get through a gate in his fence. IIRC, he was a tradesman ... I want to same plumber ... and had had his tools stolen several times.

    It just seems like trying to scare some one off is better than taking a life over a toolbox.

    My guess is that it's based on the "that bullet has to land somewhere" principle and justification for taking the shot. Prosecutorial logic might say "well, if you felt safe enough that you didn't need to shoot to kill, then you shouldn't have discharged the weapon..."

    Frankly, I think it's mostly a dumb concept and that a warning shot may sometimes be appropriate - as in the case in Mesquite - but at the same time, don't point a firearm at anything you're not willing to destroy. If it's serious enough for a round to be fired, then that round needs to count.

    Warning shots can become very dangerous, ESP if a person has adrenaline running through their system. If you draw the gun they will know you have it, firing in to the air won't make you "have it more" and will leave you with 1 less round to defend yourself.

    Personally, I feel making warning shots legal would be a bad move and would have unintended consequences. Again, that's just my personal feelings on the subject.
