If someone is killed while committing a criminal act (by police or whoever), are they arrested or charged posthumously? Would it show up in a criminal history search?

I dont think you could charge a dead person with a crime. No way to defend themselves or be punished. Read them their rights..."you have the right to remain sil...nevermind". Although a dead pope was physically put on trial so who knows.

If there was a criminal offense and there is only one suspect and that suspect dies, the offense will be investigated and cleared by exceptional means. It would not show up in a criminal history as there is not criminal prosecution.

Depending on how the suspect died will determine that offense and investigation.

Been there, done that, don't want to do it again.

At some point in history, some Texas judge (Roy Bean, etc,) probably held a trial, convicted and sentenced to die, a horse thief or cattle rustler who had already been shot or hung. The jury could have well consisted of some members of the hanging party. Really a novel idea but the defense would have had little to present.

Probably shouldn't have bothered posting this, but I just couldn't help myself.
