    Well, I was in a rush to meet up with a buddy of mine to do some fishing down on the coast. Seems I was in such a rush I didn't notice the posted 35mph sign or the police car sitting next to it and was promptly pulled over. I was informed that I was doing 45mph in a 35 and was then asked for my license and insurance. I handed over both drivers and CHL licenses and waited on a ticket I deserved. The officer was about halfway to her car, turned around and came back to my truck, handed me back my licenses and asked me to slow down and be careful. No ticket. No warning. Wow.

    By the way, we didn't catch a damn thing.

    I got asked to step out if my car and frisked on my first stop. I could have argued on the illegality of it since there really wasn't prob. Cause, but I know I'm not going to win a roadside court.

    I don't have a CHL nor do I carry in my car, but have reason to start. If stopped, is it best to let the officer know you have a gun in the vehicle, or leave well enough along? I can see it taking me 30 minutes or more just to defend way I have the weapon. Thanks.

    While a pat down for weapons is not typical on a traffic stop, its not illegal, nor is probable cause needed to perfrom one. See Terry v. Ohio.

    If he asks if you have a weapon, tell him.

    You don't know if he had PC, or an exception to the search warrant requirement. There are several

    He stopped me fur speeding, I'm a mid 40yo bald Asian male, dressed in long sleeve button down, w my wife coming back from a cirque de soleil show, had 1 drink several hours earlier, driving a lightly tinted Mazda wagon, stock otherwise at ~ 10pm, 10 over, ticket was eventually dismissed (hired an atty). I work at an engineering firm, answer w yes sir no sir.

    I believe if I had NOT presented my CHL , which I no longer have too, he would have conducted a normal stop, license- ins, ticket, go about my business.

    What makes you think you do not have to present your CHL?

    How does any of your story establish the "frisk" was improper?

    By presenting your CHL you gave evidence that you could be armed and potentially dangerous, exempting the officer from providing a search warrant. The traffic stop by itself is not probable cause, but the officer may see, hear or smell something that authorizes a closer look. You'll notice he didn't search your car...

    So before, when you DID have to show your, that gave them prob cause alone to search your car?

    I present it in hopes that it eases the officers, and that I'm a law abiding citizen.


    Sounds like I should just not say/do anything in regards to my chl.

    The CHL does not provide an exemption from the search warrant requirement.
