Since the Search warrant had expired and wasn't legal in other counties and if it was up to me? Jail time for anyone sticking anything up that poor guy's a$$, all the police officer's fired and then convicted of official oppression and Civil Rights violations and hopefully jailed so they may experience the joys of forceful anal penetration, and a settlement of $50,000,000.00 for pain and suffering and punitive damages. Sound about right?

I would expect at least that for that kind of violation. :machine:

You guys know how I feel about these threads. Keeping in mind that we only know what is reported, I have to say I cannot imagine making a search warrant affidavit based on someone "appearing to clinch his butt cheeks". Then, I cannot imagine a judge signing a warrant based solely on that. Instead, I would imagine a judge would strongly admonish me (at best).

A whole lot of WTF there. I would like to read the affidavit.

If I am on the jury, they can rename the Gila Regional Medical Center the David Eckert Regional Medical Center, as he will own it. I do not fault the police as much as I do the anal rapists.

Of course, as the story changes so might my opinion.

Sounds more like something Alfred Hitchcock would write than an actual account of events. The so called "news" is getting worse about just telling one side of the story and over sensationalizing everything, but from the way the story reads, I can only guess the lawyers were lining up to take the case.

Everything was from the perspective of what the lawsuit says. There are always two side to EVERY story. WTS, the police better have a dang good rebuttal (no pun intended).

IF and only if the story is an accurate description of the actions taken by the police/judge/doctors/hospital then there should be severe sanctions taken

Begs the question; If a rape victim gets their own justice, has a crime been committed?

I, for one, would be hard pressed to come to a guilty verdict.

Bigger story here IMO is jut how out of control those in authority are becoming, that includes judges, police, schools. of course many of these stories have missing facts but overall freedom appears to be on the losing side. Much of this begin after 911 It seems to me the terrorist won. If it went down according to the story hope the guy sues the town and everyone involved until nothing remains.

I still have an active New Mexico Medical & Surgical license. If LEO's had come to me with that story, warrants or not, I'd have told them that they were nuts ! Physicians should never allow themselves to be involved in something, anything like that. I'll bet the Sikh who is chief legal counsel for the New Mexico Board of Medical Examiners has already recommended suspending the licenses of anyone who participated in this. And, the police and judge should be punished, not the taxpayers.

    but, the dog alerted right?

Drug dog alerts are bullshit. They can train the dogs to alert to any cue from the handler in order to get what they want.

This guy needs to own the PD and the Hospitial

It's so easy to train a dog to alert on the handler's cue, the handler can train the dog to do it without knowing what happened.
