    Officers say were holding the man at gunpoint during the exchange.

    At that point, the incident became tense, with officers ordering Vichique to put the gun on the ground, and Vichique respectfully denying their request, saying repeatedly he was not breaking any laws.




    Vichique is a DUMB ASS!

    This was already posted. 19year old kid wanted attention. It seems that San Antonio should have taken care of that dumb law to begin with.
    When cops point guns at me- (hasn't happened yet) I'm gonna do what they say.

    The city ordinance states that 'it shall be unlawful for any person, other than a duly authorized peace officer, to carry a loaded rifle or shotgun on any public street within the city or in a motor vehicle while the same is being operated on any public street in the city.'

    Does this not go against the state firearms preemption law?

    LOCAL GOVERNMENT CODE CHAPTER 229. MISCELLANEOUS REGULATORY AUTHORITY OF MUNICIPALITIES
    "FIREARMS; EXPLOSIVES. (a) A municipality may not adopt regulations relating to the transfer, private ownership, keeping, transportation, licensing, or registration of firearms, ammunition, or firearm supplies. Municipal governments can enact regulations on the discharge of firearms (such as noise, nuisance or public safety ordinances); however, those laws are subject to and cannot preempt State law concerning justified use of a firearm."

    PENAL CODE CHAPTER 46. WEAPONS
    "A person may carry a loaded handgun without a permit while in or heading directly to a motor vehicle or watercraft they own or control. The statute does not specifically state the handgun must be concealed while heading to the vehicle or watercraft, and 46.02, which requires concealment of a handgun while in a motor vehicle or watercraft, is not applicable to a person while the person is traveling, pursuant to said activities. 46.15(b)(2)."

    San Antonio, a Democrat infested cesspool sanctuary city, even has a clause in the City Charter to prohibit the sales or transfer of guns and ammunition when the city manager declares a public emergency.

    Problem is, the Democrat entitlement constituency lives and plays with the gun. They will be the first to gun and run in any public emergency.

    For most any situation, I agree, but if a police officer has a gun on me and I am armed as well, such as in this type of situation, there is no way I am putting my hand on any firearm, as a matter of fact, my hand is going to be as far away from the firearm as possible. I will politely inform the officer that he is going to have to disarm me himself. Once you lay a hand on that gun your life is literally in their hands and what they interpret as a threat.

    The cop told him that they were going to take his rifle and instead of saying he understood the guy just continued to spout his memorized lines.

    Breaking and southpaw - I'm not getting shot or risking it if I'm in his position. If they're rounding us up I won't make it easy for them to find me by walking around in a crowded city openly carrying. Until this is the case- my job is to take care of my family and a big part of that is stay out of trouble.
