    Victoria Advocate | Victoria firearms store raided, owner arrested (w/document)

    Federal agents raided the store, also known as Garrett's Gun Vault, on March 13, seizing 117 firearms.A day later, they arrested the owner, Garrett Riedesel, accusing him of unlawfully receiving or possessing firearms that were not registered, according to a criminal complaint filed in federal court.
    At least four shotguns or rifles also did not have the required 18-inch and 16-inch barrel lengths, respectively.
    They were a Remington Model 870 Express 12-gauge shotgun with a 71/4-inch barrel, a Savage Arms Model 940D 20-gauge shotgun with a 9-inch barrel, a Winchester Model 1200 20-gauge shotgun with a 13-inch barrel and a Marlin Firearms Glenfield Model 30, .30-30 caliber rifle with a 131/4-inch barrel length, according to the complaint.

    "Machine guns, silencers, short-barreled rifles, short-barreled shotguns or destructive devices, such as molotov cocktails, mortars and bazookas, are the type of firearms that must be on the National Firearm Registration and Transfer Record, according to the ATF's website."

    How the F*ck do you register a molotov cocktail? Um, dear BATFE, I want to register this MC. Manufacturer: Jack Daniels, batch number: 04-12-14, caliber: 80 proof, capacity: 750 mL (standard capacity, none of that 1.75 L high capacity, that's just crazy)

    Never mind its double D's. I've been there. They never had but just a few firearms in there. They guy is a very nice guy. When I had got to Victoria and I went in there. He put me in contact with the guy who owns Victoria shooting sports. Hopefully he is.acquitted. The batfe is unconstitutional.

    No, it's more given that constitutional challenges to NFA, ATF, etc. have failed, there's no precedent to support the defense.

    I didn't say I supported it. I said the courts, including the Supreme Court, have upheld it. The same court that allowed the three-fifths rule to stand for so long and that still allows "commerce clause" overreach today and is enabled by a legislative branch spending money (and building government) like a drunken sailor on leave.

    When you turn the argument to emotional strawmen, you're co-opting liberal tactics. If you're a conservative, that's beneath you. Reason, instead.

    Well the time for legal arguments and half measures is winding down. They haven't worked. History tells us what comes next.

    These agencies and these "laws" have no basis in the constitution and shouldn't exist.

    I hope things resolve peacefully, but when the mechanism built for peaceful resolution (US Constitution) has been hijacked it makes peaceful resolution pretty unlikely. I pray for peaceful resolution every day, but it's difficult to keep my hopes up given where we're at.

    Putting someone in prison for the length of their barrel is immoral, period.

    Based on what? If there's a law, and the law is ruled just, and the legislators won't change it, how is punishing a willing lawbreaker immoral?

    You can argue the law is immoral, but saying the punishment for breaking it is is pushing it.

    I am no fan of the ATF or the current 2nd Amendment bashing lawmakers BUT............

    Having those short barreled firearms is an open invitation for trouble! Like the IRS, the ATF is set up to knock over people who flagrantly violate the law. If you make a show out of your disgust about the laws, ATF is going to badger you. Under current law, the man had multiple violations. I wonder what he expected to happen?

    My neighbor brought over a beat to Hell double barrel shotgun that had a barrel of about 12" and a stub of a stock. I politely asked him to get the thing to Hell out of my house and suggested that he disassemble it and toss the parts in the river. I obey the law and won't collaborate with those who won't.

    If you want to kick around a real pisser in government regulations, try the 922R provisions for, among other things, modifying C&R rifles. That is a MESS and sets up trap for the unwary gin owner to stumble into. If you have a Yugo SKS with a grenade launcher and decide to remove that silly launcher, you fall under the 922R restrictions. The whole 922R set of regulations is difficult to understand and is simply a trap for otherwise law abiding gun owners.

    Sorry, keeping a stock of short barreled firearms is just asking for trouble.

    Unfortunately, whether or not you agree with it NFA is the law of the land, much the same as Jim Crow in America and anti-semitical laws in Nazi Germany were not agreed with my many, anyone operating a firearms business dealing with NFA items should be very aware of this and the very real potential consequences of violation.

    'Liberal' is about as bad of an insult as we could call each other and I am familiar with and have a lot of respect for both members in this exchange so I'm asking for cooler heads.

    Maybe one day we will see the abolition of NFA but today we have to abide by the rules, whether we like them or not, under threat of firepower, extended Federal incarceration and complete loss (fines) of wealth.

    I hope this shop owner creates a great defense to the point where he sets precedence. Do I think that will happen? No. But I'm hopeful nonetheless and I wish him all the luck in the world.
