and, thankfully, she will suffer the same human foible that we all bear--she will expire. We're all born to do so . . . only she'll do it long before Gorsuch. God willing.

    YEP. God willing.

President Trump may well get to nominate 2-3 new Justices to the SCOTUS & thereby possible return many of our lost liberties to the people of the USA.

The notion of an independent judiciary is a fallacy that's why the left and right are collectively losing our shit trying to figure out who will fill upcoming SCOTUS vacancies.

And there are tens of thousands of case-law judgements that would have our founding fathers rolling in their graves.

It would be nice if ALL judiciary was required to use strict scrutiny. Feelings have no place on the Bench. Right is right, regardless of who gets their feelings hurt.

Strict scrutiny is NOT the appropriate tool in every instance of judicial review. The precedents (and not feelings) establish the level of scrutiny which is required.

If the precedents were not based on whether or not the Constitution allows it, whether federal or state, then the precedent was wrongly set.

I, unfortunately, must agree with you. When President Trump won the election in November, I felt our country had a new lease on life. I briefly had new hope that our country could be restored to the principles on which it was founded. After only slightly more than half a year, I again believe that is not to be. Washington is too full of politicians that are more concerned with losing their job than they are with losing a nation. Members of the party that nominated him are joining the Democrats and liberal media in piling on the President for what they believe to be mistakes he has made. When was the last time the Democratic leadership criticized Obama when he was President, or HRC when she was running for office. Please refresh my memory if you can remember an instance (as I said, I am getting old). All this gives the impression that the Republicans cannot govern, whether you believe they have legitimate concerns or not for dumping on the President. I fully fear the result will be the Democrats with their anti-American ideas will win back control of Congress in 2018 and continue flushing the principles of a country I deeply care for down the toilet. The Republican party has not shown the capability, or even the desire, to stop them. God bless America.

What we need here is for some upstanding patriots to kick the ass of any rat bastard that is burning the American flag!
I don't like it either, but........
So you think violence is called for to protest an activity that courts have ruled is protected free speech? I believe that is called anarchy and hate to see it expoused here as it is no better than the violent antifa tactics.
I'm pretty sure starting a fire on public property in city limits is against the law. Doesn't matter what is being set on fire. Appropriate response is to put out the fire. If someone tries to physically stop you from putting out the fire then you should defend yourself.

Meh - Lockhart's post was about burning the flag not about fires on public property and I responded accordingly.

Then you would go to jail. Burning a flag has been repeatedly defended by the courts as legal speech. I don't like it but the First Amendment doesn't care what I like. its protected speech. Deal with it and counter with your own protected speech.

What would you go to jail for?

I recall a certain FedEx driver who faced no legal ramifications for extinguishing a fire on a public sidewalk and then defending himself. The fire also happened to be a burning flag.

Exercising speech doesn't include breaking laws that are in place for public safety, such as laws against starting fires on streets and sidewalks. If someone wants to burn something in the street they would likely need a separate permit for it.

Assaulting a flag burner, violation of civil rights if the DOJ or ACLU gets involved, misdemeanor "taking the bait.":)
