    Went to the Kirby location last night. I HIGHLY doubt they sell that much alcohol. Small fridge full of beer and 2 margarita machines... they close at 9pm.

    I spent $25 on a soda, wings and veggie sticks. Even on Weds wing night, I was the only patron, everyone else was ordering to go.

    Are there any rules/regs stating they need to actually bring in 51% revenue from alcohol?

    All alcoholic beverages retailers must post one of two firearms signs.

    One for businesses that allows only LTC folks to carry and one that says LTC folks are not allowed (51%).

    I'm guessing if I don't want guns in my business (even though on premises sales of alcohol does not exceed 51% of gross sales) I could pick the 51% sign just as easily as I could pick the non-51%.

    That would probably not get noticed - however reverse the situation here and I could lose my TABC license (if they found out I sold more than 51% and chose the sign that allows LTC carry).

    yep, that's the one. There are 3 locations but that's the particular one I went to.

    Didn't know they had to post one or the other. So if I understand correctly, they are reistered for blue but they have the red posted. I would be surprised if more than 10% of their sales were alcohol. Then again, it's the wrong damn sign altogether.

    Yes, according to TABC they should have a blue sign. If you like the place, call and let them know the TABC sign is wrong and you want them to have an opportunity to fix it before you report them. If not, contact TABC first.
