    "step out of the car, we're going to do a roadside drug test" to the driver... passengers have to get out for the officer's safety.
    And if you're person who plans ahead, you drive a Ford with an external keypad entry, leave the keys in the car, and lock it on your way out. Admittedly, you have to be smooth about it and get it done before you get a specific order to drop the keys outside the car and/or leave the windows down but it's always worth a try.

    If a crooked cop wants to search your car then, they'll need to break in, one way or another. They'll have to commit to their lies.

    I didn't say to make it a jailable offense for weed... I said "Citation" (like a traffic ticket)

    I understand what a citation is, thanks. I just want to make sure when I'm driving with 30 pounds of weed from Colorado to Texas and get caught that I'm only getting a ticket. If they dont catch me then, when I turn around and start selling the shit out of it, its just a ticket? The IRS is going to love that.

    yeah, you're in the crapper there... wouldn't matter if you were smuggling high-water use toilets rather than weed in that case... remember they finally got Al Capone on tax evasion, even if they couldn't get anything else to stick.

    Well 1. You were pulled over for another reason to constitute the stop. 2. Do you really want people smoking pot operating a vehicle. 3. Patrol can get voluntary consent, happens all the time or 4. If I really want to search the car, I can arrest you for the traffic offense and do a search incident to arrest.

    The point I was trying to make... poorly, I admit. Ticketing weed dealers isnt going to prevent or stop anything, it wont solve your problem.

    Not from me you won't, it is the law and you will abide by it or violate the law as well as my civil rights in an effort to skirt around it.

    So far as I know excessive speeding and/ or reckless driving along with driving on a suspended / revoked drivers licence are the only arrestable traffic violations.
    A taillight or failure to signal or something along these lines, which constitute grounds for a traffic stop?

    Shhh, don't expose the scam. I use to wake up every day and ask who I could screw over. I always smelled that stuff when I wanted to illegally search a car. I carried a small baggie of weed I`d "find" under the seat to better my jail stats. I guess If I was still on patrol I`d have to come up with another pretext/lie.

    As a police officer, your job is to uphold and abide by the law, consequently what is in my car is none of your damned business.
    Unless or until you can demonstrate a bonafide reasonably articulable suspicion or bonafide probable cause there is something in the car of which is your bonafide concern at which point you have the lawful duty to investigate under the law.
    Until such time anything within my car is again, none of your damned business.
    It is called the 4th amendment, of which is your sworn duty to uphold and abide by.
    And the claim of cops that they "smelled the odor of weed" in a car as a means of getting around the 4th will thankfully be ended if weed is legalized.

    And some of you wonder why I raised the issue I did......

    Texas allows peace officers to arrest you for any traffic offense except speeding, open container, or wireless communications use.

    When you start your post with the implication that police routinely lie about what they smell on a stop, I take what you say with a big grain of salt.

    With what you posted about what is an arrestable traffic offense, I am guessing you are not an attorney. I did have many people who thought they knew the law in the back of my car.

    If I smell MJ than yeah it is my business what is in your car or I should say was since I retired.
    I didn't need to violate anyone's rights to do my job effectively and the one person that sued me for it lost.

    Let me guess, you were stopped and your car was searched? We're you framed? Honestly, a margarita with you might be an interesting conversation.
