    The man who initiated a verbal altercation over a handicap parking space that resulted in the death of a man has been arrested for manslaughter overruling the local Sheriff's decision not to arrest.

    While I believe the charges to be politically motivated coupled with the fact that I'm very skeptical this will result in a conviction, I have very little sympathy for this individual. I don't know about you, but I tend to avoid trouble, altercations, and arguments while carrying.

    Let's see here, getting arrested and sitting in jail, having BLM sicced on you, having to spend money on legal counsel defending a felony charge, potential prison time, potential loss of civil liberties including the right to own a gun, potential civil suits, potential financial and career ruin, online immortalization (not in a good way), psychological trauma all because I couldn't resist the urge to call out someone parking in a handicap space. Eh, no thanks!

    It's pretty clear he committed a crime as it was not objectively reasonable for him to have been in fear of his life at the time he discharged the weapon. Yes, he was knocked down but the assailant had backed away and had not continued the assault. Stand your ground doesn't apply as this assailant wasn't trying to force the shooter to flee or even attempting to continue his assault. Had the assailant continued to advance on the man while he was down on the ground, it would be a completely changed set of facts and would have been a legitimate fact pattern for "Stand your Ground".

    The Prosecutors are making the right move. Let the case go before a judge and jury, lay out the facts, and let the chips fall where they may.

    He’s been charged with manslaughter (not capital murder); depending on jury selection, I’m guessing there’s a very good chance of him being found guilty.

    According to the store owner, the guy had pulled that kind of crazy parking space vigilante watchdog thing before. Personally, I think he was looking for a situation to arise where he could put his gun to use. Well, he found one and now (as has been pointed out), he can start paying for his decision to use it!


    Wonder if he had carry insurance?

    I wish I could serve on his jury. He would walk.

    After getting violently shoved to the ground and in under 5 seconds he drew and fired from a shoved down position he had every right to nuke that thug.

    Even the sheriff in the press release said the attacker was still in a position to attack the downed man.

    I think the biggest problem he has is that big ass Zit on his cheek!!

    As with the case in most all these debatable situations, there is plenty of “stupid” to go around on both sides. Frequently, we’re not just talking ‘ankle deep’ in stupid....we’re talking, up-to-your-neck deep in stupid.

    Remember the guy who got shot and killed by the cop in a hotel hallway? Drunk, had been brandishing a pellet gun, wore loose fitting shorts which kept falling off when the police were giving him orders to crawl toward them with his ankles crossed. And he kept reaching back to pull up his shorts?

    This wasn’t a situation where he should have removed himself.
    Or even an avoidable situation.

    This was a situation that he went out of this way to create.

    Why???

    He’ll be lucky if the jury is hung and reaches no verdict...there’s just too much dooshbaggery going on with this guy IMHO

    It wasn't a good shoot. Period... Granted the guy pushed him down, but backed away. On top of that this prick had been initiating altercations repeatedly.

    Like was already said, when I am carrying I try to avoid any altercation not look for one. The guy that was killed just saw some crazy yelling and being aggressive towards his wife and children. You'd do the same in his position I think.

    I’d say he is damn lucky to only be charged with manslaughter and I do believe he will be found guilty rather easily. Will be interesting to see what the sentence will be though.
    I’m glad to see the majority here agree it was not a justified use of deadly force.

    I have no problem with someone politely pointing out that a handicapped spot is being misused.

    But the key word is politely. Then you walk away.

    Don't think a judge will convict, if a jury - who knows?

    Will probably come out okay on an appeal, if required.

    But in the meantime, what a price in time, hassle and money.

    I’m not so sure about that unless they have the ability to “judge shop”. There are a lot of judges out there who follow the old adage of, “a gun for me... but not for thee.”

    I suspect the one thing this case may do, is more tightly nail down the definition of the “stand your ground” doctrine (at least, in Florida). And having a debate over the limits and boundaries of the doctrine is probably a good thing. It’s likely to equip self-defenders (such as us) with a great deal more clarity as to the meaning of no duty to retreat in the face of physical violence.

    He deserves the charge. He does not deserve the right to bare arms. He needs jail time. He failed miserably at being a CCW, not just for himself, but for all of us in this nation. If it wasn't the guy he shot this time, it was going to be someone else in the near future.

    I treat my LTC the same as I treat my Black Belt. The honor and discipline that comes with holding either must be exercised 24/7. You never EVER instigate a fight. That's exactly what this moron did. It's cut and dry. He started the fight that caused him to shoot the guy. Lock him up.

    Was it stupid on both parties? Yes, absolutely.

    I would have arrested him if I was the sheriff.

    I am sure this will be turned into a race issue if it hasnt already

    Oh it has. Not on the scale of Ferguson or anything but "Reverend" Sharpton has made several trips down there already to try and talk the sheriff into arresting the guy.
