    While I think he could very well get off and a good case can be made for justified, I've used examples from testimony, I dont think he acted properly. I would never respond like that. Like I've said a hearty your number one as I walk away is all the responding to idiots I do.

    Having to depend on a jury is not the way you want your decisions to be ruled good or bad.

    Just keep in mind that should you ever have to use force in a defensive situation after giving that “hearty number one” it could end up costing you a large sum of money and possibly your freedom should a DA decide that you escalated the situation with your gestures.

    De-escalating is key. Often times that means walking away like an adult instead of trying to get in the last word...or finger. And it may keep you from needing that expensive defense should you ever be forced to defend yourself.

    Mess 1 is what started the ball rolling, without mess 1, him not literally pulling into the parking lot jumping out and yelling at the woman, and the odds that the boyfriend assaults him are pretty low.
    Well if we are gonna play that game, what really caused it was their shellfish act to illegally park in the handicapped space.

    I think you are missing the point.

    As far as Texas is concerned, and likely Florida, escalating a situation is extremely detrimental to any self defense claim.

    This guy escalated the situation, much like your middle finger would be considered escalating the situation should you ever find yourself having to answer for your use of force.

    Well you got me by bolding my typo from my phone. Good on you. You were the one looking to place initial blame on someone and it seems you favor the shooter.
    IF she had not illegally parked, which is a crime albeit a minor one, this would never have happened so yes, she is to blame. I mean c'mon, not the first time a GF has gotten her BF killed.

    Sorry, saying phuck you or flipping someone off AS YOUR WALKING AWAY is not escalating the situation especially when they are the ones starting the screaming n yelling. If there is any escalation it would have to be them chasing you down.

    You also havnt read any of the other posts where I said many times I would be in that situation. I refuse to allow some idiot trap me or bait me into a confrontation. Too old/smart to fight kinda thing.

    You are correct that if you go up to someone to start an arguement or escalate an argument to a physical confrontation YOU MAY remove any justification you have to respond later. It depends on how it plays out.

    Kind of like running out and blind siding some guy is escalating an incident. It goes both ways as far as that's concerned. Just sayin..

    Doesn’t matter if you’re walking away. Shit talking as your walking away doesn’t negate the fact that you’re shit talking.

    You are STILL missing the point. And by flipping them off or running your mouth you’ve already let them bait you.

    As for the guy running out and getting involved, that’s why you don’t escalate in the first place. If the shooter wasn’t being a jackass by escalating the situation with the stupid woman the guy wouldn’t have seen a need to escalate. And if he had escalated the shooter would have had a much better case for self defense and may not have even been charged.

    You are missing the point that it doesn’t matter who escalated last. It matters if the person left alive escalated the situation prior to using force. If so, it’s gonna be a tough defense.

    Well that totally changes things. The store owner is to blame now. The GF should sue the snot out of the store for setting up a scenario that got her bully BF murdered, I mean killed.

    That said, I hope you keep that attitude next time you are confronted about a handicap parking spot. Just walking away without words or gestures is the best option.
