    Don't sell it as an "SBR upper" . . . sell it as a "pistol upper". And, as noted, state that "NFA rules apply".
    I posted the question because I spoke with the BATFE about this and was told to "sell in accordance with state laws". Do I have to list as pistol upper?

    Since mine was shipped directly to my house, just like a rifle upper, there probably are no special rules for selling one face to face. Oh, wait, mine was a pistol upper, not an SBR upper. :)

    Uppers are "uppers"! Only the receivers count. I have a pistol I built on new parts! My understanding is I can make that into a rifle legally. The receiver was transferred to me as an "other". If I had made it into a rifle first, I "think" it cannot be later made into a pistol. I also believe since it was made into a pistol first, I can legally change it to a rifle. Up for valid (verified) correction if I'm wrong.

    Sell it as you wish—it’s not a firearm, or even a serialized component. It’s an upper. But by calling it a pistol upper you run less risk of chasing away “low information buyers” than you would by referring to it as an SBR upper.

    What is an “SBR upper”?

    Not really a thing...but for the sake of this thread, it’s a barreled upper, and the barrel length is less than 16”.
    Needs an SBR tax stamp if you plan on assembling it into a rifle. .

    But it could be used on a pistol without issue.

    Obviously the sarcasm wasn’t apparent enough... there is no such thing as an “sbr upper”, nothing one does to or how one uses any upper makes it an “sbr upper”. :)

    Any upper with a barrel shorter than 16” can only be used on an SBR, pistol, or machine gun, but in the end, it’s just an upper with x-length barrel.
