Yeesh, very sloppy on my part; I should have spelled it out -- the electors from NY can't vote for P and VP when those both live in NY (which would be the case in this thread's scenario) and the Ds can't win the election without NYs 29 electoral votes (among other things going their way)
So I should have said the 12A, indirectly, stomps on the Ds chances of winning given that they're both from NY in the scenario spelled out in the OP
...which raises the question -- will there be a Constitutional issue arising from the potential conflict between the 12A (in a case such as this) and the National Popular Vote compact (to which NY state is a signee)?
