Would you be breaking the order of the court, that sealed the record in the first place, by divulging it? Best to ask a lawyer or contact the judge who handled the case, by snail mail, and ask him.

If I have an arrest that was dismissed, no conviction, and then sealed, do I need to list that on the application?

I ran into similar years ago. I was accused of something years ago, but was innocent, with massive evidence supporting my innocence.

Was found not guilty at jury trial, but still had an “arrest record”.

Worse, the Court didn’t keep adequate records, only the record of “No Conviction”, not even record of what the charge had been. Unbelievable!

Ironically, before trial, I was offered a plea deal to plead to a lesser charge, get probation, and have the entire deal expunged on completion of probation. This would have erased the arrest record, too. I refused and went to trial, confident on my innocence.

But since I was found “Not Guilty”, the arrest record has followed me since.

I have had to explain this over and over for decades. Since the only thing the County Clerk can tell inquirers is “No Conviction”, the Clerk has been very apologetic & helpful to me.

Seems unfair that an innocent person must carry this burden.

The charge was so unfair that as soon as the verdict was announced, the Judge called the DPS Officer up to bench and asked loudly “Officer, why did you insist on charging this obviously innocent man?”

The stunning response was “Your Honor, he talks funny!”

Why not make an application to the court to have the record expunged. They can tell you no or they can do it and the record will disappear.
