    Wait - how does a 5-4 go if swing-judge Roberts sides with conservatives? Does that mean that the conservative group just handed Oklahoma over to the tribes? I would think that with a century plus worth of precedent, they would've nullified the claim of being a reservation. This is going to set a shitload of "indian" criminals free and now every asshat with a drop of indian blood is going to scream wrongful prosecution and demand a mistrial, a retrial, etc. Are all the PD's in the new indian territory going to get dual-cert as Rez cops? This is going to be a shit show. I wonder if I shouldn't go join one of these tribes just in case - half of my family hails from Okie country (Miami, Bluejacket, Neosho region) and I've got injun blood from both my parent's sides. :popcorn:

    THAT is a damn good question, since Oklahoma, IIRC went Constitutional carry? Reservations get to restrict carry and its damn hard to get a permit from many. We have a couple reservations in Oregon and about the only thing you can count on getting is a tribal fishing license, I have not heard of anyone not a tribe member getting a carry permit from the tribes.

    SCOTUS screwed up. Only applies IF the person actually claims to remain an Indian citizen, else US citizen and US law applies. Courts settled the Ok land isuse years ago, used to be a problem buying land in Ok, could end up being tribal land. Don't know where this came from. Making new laws!

    Sounds like a lot of people including much of Tulsa are gonna be real stressed when they no longer own property for which they paid. Wonder how they title insurance cos will handle this?

    Agree. Only concerns those individuals claiming Indian tribe affiliation (as in, being an actual member of an Indian tribe). And secondly, only those accused of a criminal offense (child molestation, in this case). With regard to determining court jurisdiction, federal* verses (tribal or state) court.

    * federal court for major crimes (per the Major Crimes Act).

    Bill’s post about carrying a gun becomes an interesting question. Since it tends to run afoul of most Reservation laws. I assume that would not be a major crime but does raise the issue of tribal verses state court jurisdiction (...assuming you’re an Indian).
