    Recently I went to a very crowded restaurant at lunch time. After getting on the wait list, I noticed that the 30.06 and 30.07 signs were posted on the side walls of the foyer. I had not noticed them walking in. I was wondering if this is proper posting of signs or if they are supposed to be on the door as you enter?

    They are posted on either side of the foyer. I can’t really say as the foyer had spill out due to the amount of people waiting. I was watching more where I walked than looking at the walls.

    In regards to 30.06 and 30.07, below is the language regarding signs

    "(B) a sign posted on the property that:

    (i) includes the language described by Paragraph (A) in both English and Spanish;

    (ii) appears in contrasting colors with block letters at least one inch in height; and

    (iii) is displayed in a conspicuous manner clearly visible to the public."

    30.07 also states that the sign must be at each entrance

    Does "at the entrance" require it literally before entering, or is in the foyer acceptable?

    What's 'conspicuous' to you may not be to me, etc.

    My opinion: Articulate this ambiguity to actual measurement.....

    I had a similar thing happen to me involving a 51% sign.

    Had something similar happen to me at Floore Country Store in Helotes. Used to be a restaurant during the day, and a dance hall at night. We would go there to eat all the time during the day, then one day my son mentioned seeing a sign out front...

    I could not find the required TABC red 51% sign, but they do have a liquor license...

    I am not sure if it has been renewed, but we just don't go there to eat anymore...

    Just to add, businesses that qualify HAVE to post the sign per the Texas Government Code Sec. 411.204. NOTICE REQUIRED ON CERTAIN PREMISES. (a) A business that has a permit or license issued under Chapter 25, 28, 32, 69, or 74, Alcoholic Beverage Code, and that derives 51 percent or more of its income from the sale of alcoholic beverages for on-premises consumption as determined by the Texas Alcoholic Beverage Commission under Section 104.06, Alcoholic Beverage Code, shall prominently display at each entrance to the business premises a sign that complies with the requirements of Subsection (c).

    So you have a defense to prosecution if there is NO sign posted under Texas Penal Code §46.035(k) 'Unlawful Carrying of Handgun by License Holder'...

    (k) It is a defense to prosecution under Subsection (b)(1) that the actor was not given effective notice under Section 411.204, Government Code.

    It is open. In the event a LEO has a different interpretation than a person he might arrest or cite, a judge or jury will interpret.

    Well in my situation, our group walked in and sat down at a table of a hamburger joint with pool tables and a bar.
    We were in view of the bar and somebody pointed out the red 51% sign behind the bar.
    I got up and went back to my truck to drop off my pistol.

    Seeing as the sign was not at the entrance, what is the legality of me NOT going and disarming myself?

    You done good, doing what you did.
    If you hadn't disarmed (or just left the joint) you'da been subject to what TXI suggested in post #14.

    There is a golf course in Odessa where the clubhouse is a restaurant during the day. Their 51% sign is behind the cash register, so that no one ever sees it until they are leaving. We had a know it all in our group one day that decided to point out to them that it was supposed to be at the door. The manager politely informed him that state law required them to post it so they did. They weren’t moving it to the entrance unless TABC made them, because they carried and didn’t mind anyone else carrying either.

    I guess I will have to start looking for these signs as I never see them. I guess I'm too busy with the bad habit of scanning people their body language clothing and hands. I glance at the door handle but never stop to read the mounds of sheit posted on doors. I would not abdicate my responsibility for the families safety by dumping a tool in the car. We would just go elsewhere, that is on the rare occasion I'm carrying anything more deadly than old man farts. Of course those make pepper spray into a mild table condiment.

    The law is not that specific

    You are slacking off.

    The full text is:

    "(iii) is displayed in a conspicuous manner clearly visible to the public at each entrance to the property."

    So that is pretty specific, especially since many places the parking lot is part of the property.
