    He was pardoned by the Kentucky governor for murder . Feds tried and convicted him.

    Federal prosecutors said Baker was prosecuted the second time under the “dual sovereignty doctrine,” which allows state and federal officials to prosecute the same defendant for the same actions without infringing on double jeopardy protections.

    Lets just do away with the 5th Amendment's "double jeopardy clause" .


    Might as well, seeing how often the liberal Feds violate it.

    After reading up on the "dual sovereignty clause", I don't agree with that either. If the outcome in one trial isn't satisfactory, try them again in another court or district. They may use that as case against the "double jeopardy clause", but IMO, regardless of how the SC ruled, it's an end run around the double jeopardy rule of the 5th Amendment.

    Understand. But the fact was he is being tried for the same crime twice. And that ain't right.

    The system is not perfect. Not every criminal pays the price we would like. But the same thing that protects the criminal protects the law abiding citizen.

    Yep... Look at this case very very closely and see if you can imagine another case recently decided by a court in a state that was a not guilty verdict and leaves open the door to Federal charges... Maybe? Maybe not?

    The system is not perfect. Not every criminal pays the price we would like. But the same thing that protects the criminal protects the law abiding citizen.

    There are bunches for sure. Federal intimidation of state prosecutors - like the feds threatening to try Derek Chauvin for civil rights violations if he wasn't convicted in state court. Feds floating the idea of charging Kyle Rittenhouse. Feds floating the idea of charging the three idiots in the Arbury murder trial. "Give us the verdict we want, or we'll charge you again"

    Nothing at all ok about anything in that story. Nothing.

    Nothing says we know this is double jeopardy more than the Feds giving him time served credit for the 30 months he already served on state charges.

    However, if anyone is going to get phucked over by DJ, this guy seems to be worthy of it. If only the Gov could be charged too.
