    Well, the good news is you're below state minimums. My 99 truck got totaled way back when and after fighting with the at fault drivers insurance company for 3 months, they finally admitted fault and agreed to pay policy limits, which they informed me wasn't near enough to cover the cost of the truck and advised me to contact my insurance carrier if I had under-insured coverage.

    They could have saved my 3 months if they would have admitted the coverage wasn't enough up front.

    They my total depending on the percentage to repair based on the value of the bike prior to the accident. Insurance carriers use different percentages for a total loss. Some may total at 70% where another company may total a vehicle at 75%. Some may total before that depending on the value of the salvage.

    I would inquire with the at fault carrier what the property damage limits are for the policy. Whatever the limit is, it has to be split between all the parties to the loss that have property damage. If they don't have enough coverage, you can go through your own carrier for the property damage. You'll have to pay your deductible but the other carrier will likely reimburse you.

    If the bike is repairable, you could also make a deminshed value claim for the loss of value to your bike. A repaired vehicle is usually worth less when you go to sell it compared to a similar bike never wrecked. You probably can't file at deminished value claim against your own insurance company due to policy language that likly excludes coverage for that type of loss.

    I really hope they dont eff me the bike needs to be totaled out. It did not have a scratch on it and only has 15000 miles for a 2013. I do not want to ride that bike again. It will never be the same if it is repaired

    Not trying to be nosey, but was the cost of a new bike that much more then the repair estimate? Or rather a 2013 with about the same miles?

    Find all your receipts for all maintenance and parts. Submit those receipts for reimbursment or as proof of cost. I was rear ended some years ago and the damage was close to totalling the truck. The receipts pushed it over and raised the total payout for the vehicle.
