    Serious question for those in the know..What would that be called if it had occurred in Texas? Theft by deception? I mean, other than a LE discount, is there any difference in a blue label gun versus non-blue label?

    I'm guessing he claimed to be a real Police Officer (may be Federal crime?) and lied on the 4473 about something.........

    Federal court so Federal crimes.......

    Gifting a gun isn't a crime unless she paid him for the gun in advance of the purchase....or she was prohibited already....

    Police Officers can buy on Dept Letterhead and avoid 4473. So a forged Letterhead caused dealer to make an a incorrect entry.

    This is what jammed him up I think, based on press release:

    May a licensee sell firearms to law enforcement agencies and individual officers?

    Yes. Law enforcement officers purchasing firearms for official use who provide a licensee with a certification on agency letterhead that the officer will use the firearm in official duties and that a records check reveals the purchasing officer has no convictions for misdemeanor crimes of domestic violence are not required to complete a ATF Form 4473 or undergo a background check. An officer purchasing a firearm for official duties may purchase the firearm from a licensee in any state, regardless of where the officer resides or the agency is located.

    Disposition of a firearm to an officer must be entered into the licensee’s acquisition and disposition record, and the certification letter used to purchase the firearm must be retained in the licensee’s files. Contact your state’s Attorney General’s Office to ensure there is no state prohibition on such sales.

    If I buy a gun for somebody that can't, is that a straw purchase?

    Even if they aren't prohibited.

    A "straw purchase" is when you lie on the 4473 or other legal doc about being the actual buyer or buying for official purposes. Has nothing to do with the end user status, though if they were prohibited that would be an add on crime.
