Yes they will use the 2018 returns, at least that is one version. Also phases out at 99K and 198K

So I suppose it assumes if you make more than X amount being laid off means your bills stop as opposed to people that make less. I guess a case could be made if you make that much you should have $ but I know people that just have bigger bills. One of the many and vast mysteries of the universe.
