    Washington Times - 16 illegals sue Arizona rancher


    An Arizona man who has waged a 10-year campaign to stop a flood of illegal immigrants from crossing his property is being sued by 16 Mexican nationals who accuse him of conspiring to violate their civil rights when he stopped them at gunpoint on his ranch on the U.S.-Mexico border.
    Roger Barnett, 64, began rounding up illegal immigrants in 1998 and turning them over to the U.S. Border Patrol, he said, after they destroyed his property, killed his calves and broke into his home.
    His Cross Rail Ranch near Douglas, Ariz., is known by federal and county law enforcement authorities as "the avenue of choice" for immigrants seeking to enter the United States illegally.
    Trial continues Monday in the federal lawsuit, which seeks $32 million in actual and punitive damages for civil rights violations, the infliction of emotional distress and other crimes. Also named are Mr. Barnett's wife, Barbara, his brother, Donald, and Larry Dever, sheriff in Cochise County, Ariz., where the Barnetts live. The civil trial is expected to continue until Friday.
    The lawsuit is based on a March 7, 2004, incident in a dry wash on the 22,000-acre ranch, when he approached a group of illegal immigrants while carrying a gun and accompanied by a large dog.
    Attorneys for the immigrants - five women and 11 men who were trying to cross illegally into the United States - have accused Mr. Barnett of holding the group captive at gunpoint, threatening to turn his dog loose on them and saying he would shoot anyone who tried to escape.
    The immigrants are represented at trial by the Mexican American Legal Defense and Educational Fund (MALDEF), which also charged that Sheriff Dever did nothing to prevent Mr. Barnett from holding their clients at "gunpoint, yelling obscenities at them and kicking one of the women."
    In the lawsuit, MALDEF said Mr. Barnett approached the group as the immigrants moved through his property, and that he was carrying a pistol and threatening them in English and Spanish. At one point, it said, Mr. Barnett's dog barked at several of the women and he yelled at them in Spanish, "My dog is hungry and he's hungry for buttocks."
    The lawsuit said he then called his wife and two Border Patrol agents arrived at the site. It also said Mr. Barnett acknowledged that he had turned over 12,000 illegal immigrants to the Border Patrol since 1998.
    In March, U.S. District Judge John Roll rejected a motion by Mr. Barnett to have the charges dropped, ruling there was sufficient evidence to allow the matter to be presented to a jury. Mr. Barnett's attorney, David Hardy, had argued that illegal immigrants did not have the same rights as U.S. citizens.
    Mr. Barnett told The Washington Times in a 2002 interview that he began rounding up illegal immigrants after they started to vandalize his property, northeast of Douglas along Arizona Highway 80. He said the immigrants tore up water pumps, killed calves, destroyed fences and gates, stole trucks and broke into his home.
    Some of his cattle died from ingesting the plastic bottles left behind by the immigrants, he said, adding that he installed a faucet on an 8,000-gallon water tank so the immigrants would stop damaging the tank to get water.
    Mr. Barnett said some of the ranch´s established immigrant trails were littered with trash 10 inches deep, including human waste, used toilet paper, soiled diapers, cigarette packs, clothes, backpacks, empty 1-gallon water bottles, chewing-gum wrappers and aluminum foil - which supposedly is used to pack the drugs the immigrant smugglers give their "clients" to keep them running.
    He said he carried a pistol during his searches for the immigrants and had a rifle in his truck "for protection" against immigrant and drug smugglers, who often are armed.
    ASSOCIATED PRESS DEFENDANT: Roger Barnett said he had turned over 12,000 illegal immigrants to the Border Patrol since 1998.

    A former Cochise County sheriff´s deputy who later was successful in the towing and propane business, Mr. Barnett spent $30,000 on electronic sensors, which he has hidden along established trails on his ranch. He searches the ranch for illegal immigrants in a pickup truck, dressed in a green shirt and camouflage hat, with his handgun and rifle, high-powered binoculars and a walkie-talkie.
    His sprawling ranch became an illegal-immigration highway when the Border Patrol diverted its attention to several border towns in an effort to take control of the established ports of entry. That effort moved the illegal immigrants to the remote areas of the border, including the Cross Rail Ranch.
    "This is my land. I´m the victim here," Mr. Barnett said. "When someone´s home and loved ones are in jeopardy and the government seemingly can´t do anything about it, I feel justified in taking matters into my own hands. And I always watch my back."



    CLIFF'S NOTES: 16 illegals crossed guy's land, he caught them, held them at gunpoint. Now they're suing him for "$32 million in actual and punitive damages for civil rights violations, the infliction of emotional distress and other crimes."

    This man is a true patriot, who is being victimized by the political correctness of our "justice" system. I hope all goes well for him and his family, as well as the local sheriff, named in this absurd lawsuit.:mad:

    We should give this guy a medal. I think it's pretty awesome that he has turned 12,000 illegals over to the border patrol..........it's also quite sad that he has to do this. The border patrol should set up a camp and give the guy a day off.

    I couldn't even read through the whole thing.

    How in the hell do people end up filing a legitimate lawsuit in a county where they entered illegally?

    What's worse is how the hell can a man be sued in a court in this country for holding trespassers. If they were US born citizens of the United States that trespassed and he held for LE to arrive, the only charges would be against the trespassers and an attempt to sue the land owner would be tossed in a trash can.

    I guess the message is, the guy shouldn't be holding illegals who are trespassing at gun point for the Border Patrol. The fact is, subsequent groups of Mexican nationals trying to cross might be convinced they need to head back home, or at least try to go somewhere else to cross when they come up on the remains.

    These dirtbags want more freebies.Bad enough I see these illegals living in my area and when I report them they do not do anything.The Mexican consulate probably has their hands in filing the lawsuit as they are a bunch of jerkoffs.I hope he counter sues for them leaving hazardous waste and for damaging his property.

    I use to race in Mexico and Mexico is a 3rd world country.
    The LE in Mexico is so corrupt we would take on average 2,000.00 in bribe money so they would leave us alone. ( we were not breaking any laws )
    I don't blame these people for wanting to leave Mexico but to do so illegally is out of the question.
    I have to say it's a sad situation that can't be fixed without a complete over throw of the Mexican government by the people. This will never happen as these people are so poor they can't mount a rebellion.
    It's total BS that an illegal can file a law suite under these circumstances.
    The property owner IMO has every right to protect his property in this manner especially when it's a know long term problem.
    Just another example of how our legal system no longer protects the rights of the victim only the criminal.
    Considering the circumstances "BUZZARD BAIT" comes to mind!!!!

    The more I read that article the more sick to my stomach i felt. That makes me sick that lawyers would even take that case. He did everything right in mind. He is taking more action to stop these criminals than the government is doing!!! Keep rounding them up I say!!! I salute you!!!

    This lawsuit is stupid. The guy was on his OWN property!?!?!? WTF. I could see this bs lawsuit fly if it was on public land or something but not on your property.

    Hope everything works out in his favor.

    It's amazing how many ways the mindless idiots of our society seek to demonize self defense, defense of property, etc. Sometimes I wonder who is left that even stands for PRINCIPLE anymore instead of flavor of the moment headlines and bandwagoneering. ;)

    On a more pleasant note, awhile ago an engineer at my previous job told me a story. He was in the Marines just a few years ago. He was stationed at 29 Palms and one night they were on a training exercise in the Mojave. Well they were moving to an imaginary objective and, in the middle of the night of course, practically tripped over a group of illegal aliens moving through the desert. Long story short, that group got one hell of a welcome party to the US, being confronted by a platoon (or whatever sized unit) of Marines with M16's (no ammo though) screaming all sorts of commands to them. Hahaha, that must have been a sight to see.

    I do feel for people that must have it so bad they feel the need to illegally immigrate to another country to make a better life. I mean I definitely don't hate illegal immigrants (criminals is a different story) and the humanitarian side of me wants to help. The reality of the situation, unfortunately, is we can't help everybody and we have enough problems of our own in this country without having to support the rest of the world.

    This man should be rewarded for his actions, not punished. I can understand how such harsh words came out his mouth in consideration on what illegal immigration and drug smuggling has done to his property. If I was him I know I wouldn't be as nice as he was. Too bad it's illegal to set booby traps on even private property. I say we mine the border, anybody who makes it though... if they had the balls and ability to make it through a minefield they should be able to become citizens :)

    I hope that rancher wins. Those illegal's were trespassing and they ought to be lucky they weren't shot. If that rancher has had problems in the past with illegal's destroying his property, killing livestock, etc. at least in Idaho its justified to shoot them. Don't know about Arizona's laws, but I would think that killing of livestock and destroying property is enough to get yourself shot and/or killed.

    That lawsuit should never have even been let go to court, the judge should have looked at it, sent the illegals back to their country, and warned if they try it again they will be shot.

    Why do we have so many illegals coming to the US anyhow, most of the jobs that used to be in the US are now in Mexico. Hmm, apparently they haven't got the memo yet.

    I used to live in AZ, so I have been following this case from the beginning. Sadly, AZ is not a state where deadly force is authorized to protect property. Yes, they have open carry, but not appropriate defense of property :confused:

    Either way, he does have disparity of force on his side, and he did not actually shoot anyone, but it is still messed up that these dirtbags are even still breathing American air.

    Haven't gotten the memo? He!! they can't even read Spanish! Illiteracy rate for Mexico is through the roof. If they could read Spanish, they could get a decent job in Mexico....at one of OUR factories.
