    Street racing is not the same charge as speeding. AND we are referring to carry wthout a CHL (Concealed Handgun License). The law posted earlier on this page is the applicable law, and has nothing to do with carry under a CHL.

    That said, if a CHL holder is charged with Disorderly Conduct or a Class B or higher, his CHL will be suspended.

    It's OK to carry it in a bag [ covered] going to the range or a hunt or whatever. The concealment part would be concealed on your person, that would take a CHL. Can you just put it on the floor board to keep it off the dash? That's like putting it on display for sure. You really have to study the laws before you go to a different state these days. I wish it was uniform from state to state.

    Actually, if you're going to an activity that involves the use of firearms (hunting, gun range, match), the law doesn't say HOW you have to carry it.

    This law has been on the books for decades and has never been an issue.

    The September 2007 law that says 'your car is your home - so long as it's concealed' covers you when you're carrying your handgun around when you're not going to a firearms related activity.

    Regarding carry under 46.15 (b)

    Texas Penal Code

    b) Section 46.02 does not apply to a person who:
    (1) is in the actual discharge of official duties as a
    member of the armed forces or state military forces as defined by
    Section 431.001, Government Code, or as a guard employed by a penal
    institution;
    (2) is traveling;
    (3) is engaging in lawful hunting, fishing, or other
    sporting activity on the immediate premises where the activity is
    conducted, or is en route between the premises and the actor's
    residence or motor vehicle, if the weapon is a type commonly used in
    the activity;
    (4) holds a security officer commission issued by the
    Texas Private Security Board, if:
    (A) the person is engaged in the performance of
    the person's duties as a security officer or traveling to and from
    the person's place of assignment;
    (B) the person is wearing a distinctive uniform;
    and
    (C) the weapon is in plain view;
    (5) is carrying a concealed handgun and a valid
    license issued under Subchapter H, Chapter 411, Government Code, to
    carry a concealed handgun of the same category as the handgun the
    person is carrying;
    (6) holds a security officer commission and a personal
    protection officer authorization issued by the Texas Private
    Security Board and is providing personal protection under Chapter
    1702, Occupations Code; or
    (7) holds an alcoholic beverage permit or license or
    is an employee of a holder of an alcoholic beverage permit or
    license if the person is supervising the operation of the permitted
    or licensed premises.

    As you can see, only two of those state the condition of the weapon.

    As for my question, in Idaho, can you just put on the floorboard instead of your dash? It would still be in plain sight right? Or does the law say on the dash?

    This being a site dedicated to Texas Gun Talk, you probably need to look to an Idaho resident that you trust knows Idaho laws. Otherwise someone is just going to be looking it up on the Internet for you....which you can do and interpret yourself. ;)

    Texas law says nothing about loaded or unloaded when transporting to a sporting event involving firearms (gun range, match, etc).

    Yes, you did indirectly. If the gun is within reach, but a mag or ammo is not, it's not loaded. If it's loaded, a mag and ammo is within reach as well. So in the context of your own post, yes, it matter a great deal.

    I get the 1st 2 questions and clarified your post above, but the rest makes no sense at all unless something got deleted.....but in your words, does it matter? ;)

    BTW, there's several pages after the first question that your replied to, and that very thing came up and was addressed already. There's a stickied thread that has all the primary laws which explain the major questions about carrying or possessing hand guns.

    I thought if you didn't have a concealed weapons permit, it was illegal to conceal a weapon anywhere. Although I do put mine in a range bag when I'm out cause I don't want it sitting in plain sight if I run into the store for something.
    In Texas it must be concealed, we do not have an open carry law.

    just to clarify.....only people carrying under the authority of a CHL, acting as a PPO (Personal Protection Officer), or carrying in the car under PC 46.02 must conceal. Security Guards must carry in plain view, and all others, including hunting or while engaged in a sporting activity or traveling to and from, on your own premises or premises under your control, traveling, etc., can carry openly or concealed.

    Since this is Texas Gun Talk, you have to consider that most, if not all discussions of law are referring to Texas. Many states, Idaho may be one, have strict laws on concealing a handgun while open carrying is unrestricted or in the least, it's obvious the state would rather you open carry than conceal.

    Not everyone notices that a member is from out of state thus questions and differences in the law can become confusing. Maybe we need name tags with our states flag on them.
