Their victims weren't spared death, why should those responsible be spared?

I read an article claiming that due to activities performed against them, it's been tied up for 23 years. One guy was water boarded like 80+ times and the legal system is treating them similar to you and I. So 20+ years late and unable to move forward under those rules, there's a chance going to trial could result in being set free. So a plea deal with the death penalty off the table.

Because death at this point would be welcomed, as they would be martyred afterward.

Plus, for Muslims death is seen not as the termination of life but the continuation of life in another form.

In Islamic belief, God has made this worldly life as a test and a preparation for the afterlife. With death, this worldly life comes to an end.

It is merely a transition and does not adhere to the traditional depiction in other religions and/or societies of death as painful or fearsome.

It is simply the spiritual soul moving to Ākhirah (الآخرة), the hereafter.

As such, a never-ending stay at Club GTMO (BT/DT) isn't really desirable. It will also cause their memories to fade even further from the collective Muslim memory!
