    The Supreme Court has ruled 5-4 that the DC Handgun ban is unconstitutional and afirms individual right for hunting and self defense!

    Answering a 127-year old constitutional question, the Supreme Court ruled on Thursday that the Second Amendment protects an individual right to have a gun, at least in one’s home. The Court, splitting 5-4, struck down a District of Columbia ban on handgun possession.
    Justice Antonin Scalia’s opinion for the majority stressed that the Court was not casting doubt on long-standing bans on gun possession by felons or the mentally retarded, or laws barring guns from schools or government buildings, or laws putting conditions on gun sales.
    In District of Columbia v. Heller (07-290), the Court nullified two provisions of the city of Washington’s strict 1976 gun control law: a flat ban on possessing a gun in one’s home, and a requirement that any gun — except one kept at a business — must be unloaded and disassembled or have a trigger lock in place. The Court said it was not passing on a part of the law requiring that guns be licensed.

    Clear to me is the fact we must have a president who selects conservative supreme court judges.

    Clear to me is the fact we must have a president who selects conservative supreme court judges.

    It would be nice to believe that a psuedo, faux, conservative candidate, like we now have running for president, will be able to install conservative justices with a majority of liberals in the House and Senate. Realistically the dem witts will block all conservative nominees for the Supreme Court. It is of supreme importance to NEVER vote a liberal into any position of importance!
    The pendulum is still swinging to the left, I just hope I live long enough to see it swing back to the right, as it certainly will someday. What scares me is, what kind of catastrophe do we have to endure, to wake people up, before that happens.:(

    I agree as an old timer I have never seen a time like this highly unpredictable but it appears we are on the road to socialism, a rich/poor society, GOD only knows why anyone would want that but we have many leaders that seem to work in that direction.:(

    However you interpret it, it's a wonderful day to be a gun owner in the U.S. This isn't the cure for the Brady Bunch and their ilk, but it sure is a start ... See the NRA says it will be filing suit in Chicago and elsewhere to have similar Draconian gun laws overturned. hear hear!!

    I took the time to read the entire ruling, all 64 pages :p and part of the desenting opinion too. man it isnt all we wanted but it is more than I expected. we are at least on the right road if we can just stay there.

    It is a major battle won but it is not the war. We need to keep at our elected employees to get rid of other laws.

    Our second ammendment freedoms will only remain so long as we, the people, take the action necessary to keep them. This is done at the ballot box, with political contributions, with e-mails and letters to your state's representatives and senators and to local politicians.

    I am not suggesting that the 2nd ammendment makes me a one issue voter but it is a major issue to me (as are all the constitutions provisions) and it is certainly a vote breaker for any one running for office.

    Yeah, the decision does leave something to be desired though. I mean it's definitely a step in the right direction. However some of the terminology in the bill was ambiguous at best, especially in regards to the whole "bear arms" part. In case anyone didn't catch this, the ruling stated that Heller was to be issued a carry permit so that he may carry in his own home. DC Mayor Fenty also made a statement that while they would have ~21 days to come up with some regulations, that DC would still not be allowing concealed carry in public. So basically the whole "bear arms" section of the 2nd amendment has been ruled null and void in effect, at least in DC, for now. Also, the ruling stated basically that bans on carry in public were not deemed to be unconstitutional and that they weren't going to rule against such bans at this current time. Now at least we have a good ruling in our favor, however it still left much to be desired I feel. Only in America would we come up with 157 pages discussing one damn sentence. It really kind of follows the whole deconstructionist mindset. That is just entirely too much debate, discussion and wording. Things should be more simplistic than that. Oh well.

    The ruling was more or less what I expected. The liberals all went for leftist dogma, the conservatives interpreted the amendment like it was written with historical analysis, and the swing vote decided it.

    I expect that the net change will be that de facto outlawing of guns via a "may issue" permit law like in DC will be illegal, otherwise "reasonable restrictions" may be quibbled over but most firearms laws will continue on unaffected by the split decision. Unfortunately that means that whatever flavor AWB II takes, it's not going to see any constitutional hurdles. Going much further than a revived AWB, on the other hand, probably won't get any traction.

    I'm wondering if Perry will re-think his point on the open carry issue here in TX, sents the number of signees is up to 15180 as of 0054 June 28th 08. One can only hope, after doing what they can.

    I think there will need to be a significantly larger number of signatures before an open carry bill would be considered. I think it's kind of ridiculous that there are other states with open carry, and out of all of the states in the US, Texas is the one state where you would assume we'd have open carry. I mean this is Texas damnit! ;)
