    I have some company calling me & saying I owe for a Cashnet transaction that was supposed to have something to do with Bank of America. It's supposed to have been a payday loan. I think they are a bill collecting company that is portraying itself as a litigation company. They say that they are serving me papers, unless I pay in full, now.

    I don't owe anyone money, never took a payday loan in my life. I've always paid my bills.

    So, the question. The only thing they have correct is my name & social. I think they got my phone number via some search. They have the wrong physical address and email address. I went to Bank of America yesterday and I don't have an account with them. I do, however, have an old credit card with BOA. At the time of this supposed payday loan, I had $23,500 worth of available credit on that BOA card and no balance due. BOA says I did not have any other account at the time. The collection/litigation comany says that money was deposited into a BOA checking account, well, the partial account does not go back to anyone with my name. BOA searched just my first/last name and had 3 other people with the same name, the partial account number was not for any of their accounts.

    The guy from the collection/litigation company is a jerk. I told him all his info is wrong & they need to remove my social security number, it's not me. He just said that they are suing and do I want to give my correct address so I don't lose by default or get a failure to appear warrant issued on me.

    What to do? Should I give my correct home address or just forget these jerks forever and accept that one day I may have to go through a lengthy process of trying to get it removed from my credit report? IF they are legitimate and I gave them my home address, I'd be happy for them to sue me......I don't see that they could possibly win. I can show that I didn't need a payday loan at the time (I can use checking & savings account balances, plus credit that would have been available to me at the time).

    Ask the guy for his name, company name and address. Then send a certified letter stating what you just said, and demanding they cease and desist

    It's a civil case so I don't think there would be an FTA and a warrant, they could subpeona you and if you don't show you could be held in contempt I think. I would think they would have to show that they indeed did more than harass someone by phone to prove they made an attempt to contact said debtor. Get their company info, location and do a BBB search for them, it might be a scam.

    My biggest concern is them getting a judgement against my name & social. That could take some serious work to clear up if it got attached to my credit report. That's what really makes me mad.
    They won't discuss it, they just say they'll see me in court. Fine.....but you have the wrong person & besides my phone number, they have no other way of contacting me. So, if they really did sue, I'd never know it until I have some ding show up on my credit report. I have excellent credit and don't want to risk it. But, I'm not going to the extent of paying for some slackers bill.

    If you can get a number off caller ID or from them to call them back try checking them through this site http://800notes.com/ and see if anyone else has posted similar complaints

    Good call, see link below. The second page has a long response that gives a ton of info. Apparently this is all tied back to some guy in Grapevine. He purchased some junk debt and has no chain of custody. It just irritates the fire out of me that I am spending my time looking into this. See what you think:

    Here is a classic example of someone who should not be in the junk debt buying/debt collection business. Jay Brian Ledford, 45, of Colleyville, TX is a Certified Public Accountant who may have succumbed to the allure of the bottom- feeder debt business, without any background or prior training in it. It appears to me that he saw a potential for money that is is ill-equipped

    At least that is what I found in researching him and his organizations.

    Jay Brian Ledford appears to have gone out and purchased portfolio’s of old, (mostly worthless) junk debts from one of the worst junk debt collectors, that used to operate in the industry. That organization was CSGA, LLC an illegitimate offspring subsidiary of Bronson & Migliaccio, of Buffalo, NY. B&M are Collect America franchisee’s who attempted to branch out on their own, and failed miserably. CSGA no longer operates, they failed because the debts they were collecting on were old, out of statute, containing no valid chain of ownership, which caused CSGA, LLC to issue bogus affidavits and claims that almost never met most state legal standards. B&M took a financial bath on CSGA as did the majority of appearance lawyers they hired to collect on these junk debts.

    It appears that in his haste to enter the junk debt business, CPA Ledford purchased a CSGA portfolio and is attempting to collect on them through NATIONAL RECOVERY GROUP, LLC, A BUFFALO, NY BASED COLLECTION AGENCY. A check of several state records shows that Ledford does not have debt collector licensing or bonds anywhere in the U.S., which appears to make them an illegal debt collector.

    The good news for consumers is that Ledford and National Recovery appear to be smart enough not to place these bogus accounts into consumer credit files. Perhaps the risk of a Class Action lawsuit is a good deterrent for them or they may even be smart enough to realize the majority of these accounts are out of statute in most states.

    First a Certified Public Account, now a junk debt, bottom-feeder, but wait…that’s not all! Ledford also is involved in selling consumers a membership plan in health care benefits called the Platinum Capital Benefits Card.

    My advice to consumers contacted by NATIONAL RECOVERY GROUP, LLC on debts owned by:

    Platinum Capital Investments LP Investments, Inc.
    Riverwalk Holdings, LTD

    is to hold them to the Fair Debt Collection Practices Act (FDCPA) by demanding complete validation along with a chain of ownership. It is my impression, based on the information I have, that they will find that a very difficult if not impossible task to perform.

    Having no licensing or bonds may also raise the specter of potential legal actions for collecting debts illegally, which would be the decision of a consumer law professional.

    Based on his total lack of experience, the dumpster trash accounts he purchased, his inability to produce any valid chain of ownership or reasonable debt validation and other bone headed moves made by this collector, I predict that Jay B. Ledford and his debt collection companies will likely be out of this industry before too long.

    These predatory scumbags need to be dealt with harshly. it is unlawful from them to threaten you with something they cannot lawfully do. Threatening you with arrest for FTA is unlawful.

    You should look at the fair Debt Collections Practices Act and the Fair Credit Reporting Act.

    I just got off the phone with the Texas AG office. I will be filing a complaint. They also recommended that I file a complaint with the FTC, American Collectors Association of Texas, and the NY AG (since they have an office in NY). I'll be doing all of this, I won't be harassed for something I don't owe and never borrowed.

    I'm fuming that they threaten to sue me, take my stuff, charge me with check fraud, and have a warrant for my arrest (since I told them that they don't have my correct address, I wouldn't know if I was supposed to appear....they said a warrant would be issued.....yadda, yadda). They are really irritating the wrong person, they need to get their info right and go after somebody else.
