    Suspect Jackson was transported to DallasPD Headquarters where he wasadvised that he wasbeing detained under investigation and read the Miranda warning. Suspect Jackson stated that he understood his rights and waived them, consenting to an interview.

    TPC9.42 is conditional upon TPC9.41 being fulfilled. 9.41 references one’s own personal property.

    9.43 covers property of a third person. It says if 9.41 or 9.42 are met AND
    Either The “good guy” needed to reasonable believe a theft has occurred OR
    The good guy was asked to help, had a legal duty to help, or the land/proprety was under his care

    THEN good guy had legal justification to use force or deadly force to protect someone else’s land or property.

    Except "good guy" talked to police without a lawyer, and locked himself into a story that he shot out of concern for the safety of the two women, not to protect property:

    Suspect Jackson stated that he saw the altercation and became concerned for the safety of the two women who worked at the store that were being assaulted.

    It also seems the two women had opened up simultaneous cans of whoop ass and were giving the deceased an ass whooping:

    Surveillance video footage showed complainant Betts assault the witnesses and showed witness 1 striking him with a stick at one point. Immediately before suspect Jackson shot complainant, he was running towards the door and being hit by both witnesses, who then moved and were not near him when suspect shot and Killed complainant Betts.

    Agree, lots of gray area in this case. Based on the available information and sticking to a strict interpretation of the elements of TPC 9 Subchapter C, I can see it going either way.
    Even with a strict interpretation, the question in my mind is (without having watched a video or anything) "is it reasonable for him to fear SBI?".

    Was it a theft (shoplifting) where he discarded the property and was simply fleeing or was he attempting to maintain control over stolen property during the assault?

    Ultimately it will go to a jury...no way the grand jury will no bill him....DA will make sure of it....

    It will be a hard case for a defense attorney since he already "testified" to the cops.......as stated many times earlier in this thread...moron.....

    Maybe our DFW members will keep us apprised............

    According to search records, Jackson does not have a criminal history. He waited for police to arrive and agreed to an interview at headquarters.

    Jackson said he was "concerned for the safety of the two women" and aimed for Betts’ leg. It’s unclear where Betts was hit.



    The above was perhaps the biggest mistake this man could have made in this situation.

    ”I’m glad my client talked to the police” said no attorney, ever.
    I feared for the life of the two women. I want a lawyer before I answer more questions.

    Here is a case where it goes farther - clerk went after two robbers after they left. He opened fire on the thieves and they returned fired. The clerk was killed and, wait for it, they are not charging the thief who killed him with murder because it was "self defense."

    Interesting takes here, and so many elements. If he had left the store and had come back to fight, how would the shooter know it was robbery or stopping him from fleeing with goods? all he saw was altercation and fists going around.

    Did the woman ask for assistance? 'Stop him!' etc

    But yeah, guy opened his mouth and pegged his story to shooting him in the leg to stop him..

    It's all up to the DA, but this doesn't look good for the shooter. Not self defense, not laddies defense, just the robbery part.

    The man was punching a woman, (force disparity) but not deadly force, so not justified, right? even if it was during the commission of a felony (robbery)?
    You already shown that you have no idea. Say disparity of force then say "not deadly force"? How do you know? Disparity of force is male against female, healthy against the infirmed, one against many, a known trained combat expert against regular joe...........

    It may have been a political arrest......knowing he was justified but arresting him to avoid protests............
    We can talk about this all day. I was raised to never hit a woman. Not to mention he was doing so while commiting a crime. Maybe this man robbing the store didn't deserve to lose his life however, I believe it was justified. Kevin Jackson should man should be set free.
