It use to be illegal but that was changed a few years ago..

However I will say there are many stipulations that a LEO could arrest someone on. And I'm guessing perhaps since Mr. Aiken wasn't on his way to a range or hunting, they got him on that.

I lived there too and there isn't a day that don't go by since moving to Texas that I don't thank God I am where I am.

Still a felony to possess it until you can prove you were enroute. Which means you get arrested first in a lot of cases. Happens frequently enough to the point where people carry and follow route instructions from their home. I've had family friends get nailed because a few rounds were loose during a stop. There's no tolerance for guns, even out of state just passing through have issues, regardless of federal law. Cluster duck that state, is.

So Ben, are you saying that the presence of the ammunition is what made it able for the judge to disregard the moving exemption?
In his speech, he did not give an exhaustive anaysis. However, my recollection was that the instructions from the judge to the jury to disregard the moving exemption was completely groundless, otherwise Gov Christie wouldn't have commuted the sentence so readily and that judge would not have been subsequently removed from the bench.

According to his talk, basically all possession of handgun ammo is illegal, period. From that baseline, some explicit exceptions allow possession for enumerated purposes. "Moving house" was simply left off the list of exemptions. He admitted that he was technically in violation of that law but his point was that the logical conclusion, that it was impossible under the law to move your ammo from house to house, was so insane that he should be able to get some judicial relief for an obvious oversight in the law. As I understand it, one of his legal battles is to get a recognition from the bench that if the law allows you to move your pistols from house to new house, that should constitute an implicit recognition that there is also an exemption allowing ammo to be moved.

I'm stretching my memory, here, so I hope one of the other attendees will chime in and correct me if I've got this wrong.

When I'm on my way to the range with a truck full of guns, I usually go through at least 3 school zones. Two of them are completely unavoidable. I chuckle every time at how bad it would be if I got pulled over. At least around here, I think that the officer would be understanding of my situation and send me on my way. Makes me glad I don't live in NJ!

Theres an exemption in the federal law if you have a CHL. I'm not sure if it applies to rifles or if you have a CHL.

I thought the exemption was only for handguns that are concealed on you or in the vehicle...but i could be off. I'm a slow learner and all. Lol

And only if that CHL is issued from the state you are in. So everyone with a CHL from any state other then Texas is a felon under federal law.

Heart breaking. This is the soft socialism of laws on top of laws where you cant do or say anything or go anywhere without potentially breaking some law. If they cant eliminate our freedoms outright they will write laws on top of laws so you will eventually fall into their trap. I hate this and the weak politicians and voters that see this as justice. Meanwhile some gangster is driving around in a stolen car with a pound of meth and a stolen AK.
