I agree 100%Too beefy is fine; doesn't mean he's using extra capacity of hardware.
Wear suggests he only uses the 2nd slot from bottom- drop hitch. Ugly solution, but a solution.

So IF..and I mean IF..because I don't know his reasoning..but if he put a small excavator or something like a 8500 lb skid steer on a 20 ft flatbed and towed it with that half ton truck..that would not likely be safe..I don't know about legal..but if he lost control of that in traffic on I35..someone besides him is gonna likely be harmed or even killed.
So it may be "on him" as you say..but it will be a hell of a price to pay if he killed someone
