    I have a story and am looking forward to everybody's thoughts, don't hold back, I can take it. I'll do the Readers Digest version.

    The deductable on my health plan is $1500.00 a year & I can't get an appointment with a doctor in my network for three weeks & would be out around $435.00. From time to time I get insomnia & migraines. The first week of November I drove to Progresso, Texas parked my car, walked accross the border into Nuevo Progresso, Mexico. I saw a Mexican Doctor & he prescribed valiumn (50 count) & generic vicodin (20 count). I had the prescription filled, bought Kahula & vanilla extract for my wife & had lunch. I walked back accross the border, claimed everything in customs. The customs agent said I'm allowed 50 of each medication after he inspected them. He asked me to be sure to pay the duty for my Kahula. I did.
    Heading home, 50 miles North of Mexico, I stopped at the Border Patrol checkpoint in Sarita, Texas. The agent asked me where I was comming from & I told him. He asked me to exit the car and show him the medications. I did. I was arrested, charged with a class A misd. and I was in jail for thirty hours. They impounded my car, my medications & my pistol. I have never been arrested. I have no record. They "lost" the paper prescriptions......

    That's a terrible story man,and every honest americans worst nightmare. It's a shame things like this happen to honest people that think they are following the laws to the word.

    I am guessing that if it is a state charge, it would be "Possession of a Dangerous Drug", which is a class A. But why would Border Patrol be using state law to charge someone?

    yeah, a BP agent is not authorized to arrest on a Texas misdemeanor. And possession of those drugs with a prescription is not a violation under state law. That is why I think the whole truth ain't being told here.

    Also, I have been thru Sarita more than once. I was asked if I was a citizen, and asked to roll down my back window each time. No questions about where I was coming from or going. Again, this all makes me suspicious.

    I have arrested more than one person with a pocket full of vicodin (not in a script bottle) with an explanation of "I have a prescription..."

    Which makes perfect sense because I always dump my meds from the bottle they came in into my lint filled jeans pocket and throw away the bottle so I have no proof the script is mine.

    In that case.. I was given a bogus ticket over a year ago for "improper move left" <---what I was actually charged with... Breaking a physical barrier is what I did... Entering Mopac from 360, or trying to...left turn signal on, car blocking me, he should have moved left to allow me in but he did not..two lanes to the left of him wide open...so I speed up to enter in front of him...there were multiple cars behind him, and a car behind me, so acceleration was the best choice imho...I merged in front of him, but broke a physical barrier in doing so...nothing dangerous about what I did...Cop thought I might have been drinking...I didn't speed, as in go over the speed limit, just broke some imaginary line...After finding out that I was not drunk, and I'm sure that would have been the high point of his evening, he insist on writing me a ticket because they must treat everyone equal...This is where I go ahead and call BULLSHIT!! As I am sure had I been an "illegal" I would not have received a highway use award... I did not get mouthy with said officer, I was polite and respectful.. Oh, and did I mention that prior to entering the highway, there was a police car that was headed in that direction, but at the last second decided to stay on the feeder road, and you guessed it broke that imaginary line...No, he was not after anyone, no lights, nothing... So there we are, my wife and I in our Honda Accord, we'd just come from a very nice birthday dinner at Eddy V's and now the night was shit...All because this moron had a quota to meet... Clean driving record, polite, out with the wife on a date, Menace to society I tell you!! Was I fired up? you bet ya.. $112, plus driving school, and all those hours wasted, because one asshole cop got pissy that he didn't get his man... Now generally I hold police officers in high regards..I think there under paid, and over worked... But this guy..

    I'll stop before I say something I'll regret...you get the picture...oh, and feel free to tell me why I am wrong, and that I broke the law blah blah blah...

    The original poster could have been an attempt to farm email addresses from gun owners for some reason... notice "his email" was posted prominently in the thread...

    Dont stop on my behalf...I wasnt there, I cant tell you you were breaking the law. Maybe you just got screwed that night....(im willing to bet he doesnt have a quota)

    i went to jail while carrying and my gun wasn't released to me until i could show a reciept to prove ownership. thankfully i found the reciept.

    The class A was possesion of a controlled substance. Texas does not recognize Mexican prescriptions (a fact a Texas LEO should know). The Border Patrol arrested me & turned me over to the Kennedy County Sheriff. I don't know what arrest the border patrol is authorized to make but that's what happened to me. The Border Patrol told me the weapon made it a fellony but the Lt. w/ Kennedy County decided to charge me with the misd., he treated me fairly & has my respect.
    As to texascop2's post. Mexican prescriptions come in the original manafactures packaging, not a bottle like here. I had the written prescriptions with the doctors signature & the pharmacies stamp with the medications. The Border Patrol took them into custody but did not include them with the chain of custody & they did not return them to me.
    I once thought lijke you. Most good citizens do, until something happens to you.
    I too have been through the Sarita checkpoint & others without issue. Does not chang what happened this time.

    very little...its commonly reffered to as a hijacked thread. it happens quite often here.

    Hijacked (or detoured) threads are part of what keep forums alive. Otherwise, they become stodgy and full of thread Nazis who forget the discussion and simply police the direction of the thread. I really think this place is a lot friendlier because of its more lenient posture.

    BUT

    We do need to try and answer the OP's questions in a thread before we derail it completely.
