    To be clear, no trial court has actually decided anything on the rule other than whether or not an injunction was approved.

    The hot air about the Fifth Circuit making a decision is the Fifth Circuit directed the lower trial court re-examine it’s decision on an injunction and, in that re-examination, to do so in light of the Circuit’s guidance, and to do so within 60 days.

    Pretty much this is the teacher telling the child not only was the answer wrong, but this is why the answer was wrong and re-do the assignment.

    She is, however, in a limo on the way to the venue.
    I can agree with that. I hope she is not stuck in too much traffic on the way. As the lower court ( trial court) has only addressed (incorrectly per 5th appellate) , the injunction, we will be waiting for some time before actual arguments over the legality, or constitutionality, of the " final ruling" are scheduled to be heard, by the lower court.
    Unless some other case renders this moot it will end up on the SCOTUS docket, hopefully under a stay, in a couple of years.

    After 93 days, I decided to email the ATF about my application.

    To my surprise, I got a reply less than 12 hours later...

    "Your background is in a delayed status with the FBI"

    No further info. I don't know if there is an issue with me, or they are just behind on processing applications.

    Anyone who knows my background will know it's not me. I have been vetted by the FBI on several occasions without issues. I've had other Federal, state and municipal agencies also run background checks on me without a problem. If there was something of significance, I wouldn't have a job!

    Of course, they could be reading my posts on here! ;););)
