    i dont have any idea exactly what the 'victim" here can sue for - but i think there's a great deal of jury appeal here and any lawyer worth a damn would know that and go after as much as he can get.....the city of canton would be foolish not to try and settle this

    Hmmm.... I love how everyone is so sure there is nothing to sue on here. Without knowing Ohio state law, I'm not sure anyone could say for certain. At a mimimum, you have potential Federal violations of his civil rights(you don't have to take a Rodney King style beating to be eligible for this), you have potential state law claims for intentional infliction of emotional distress, unlawful detainment, assault, official oppression, negligence on cops part, negligent retention on city's part(especially if he's been involved in 18 incidenets), garden variety negligence, conversion(for taking his gun), and I'm sure others I'm not even thinking of. Like you said just jk, the jury appeal alone would make this a great case, but add these facts to it and I think you have some actual claims with meat on their bones.

    I wouldn't sue them unless I had to. I would ask them to settle for an apology and the officer's resignation.

    At least give them a shot to do the right thing before you stick it to them. Too many see these events as a revenue opportunity instead of righting an injustice. Going strictly for money, IMO, speaks loads about someone's integrity.

There are many advancements in the fields of medicine, government, environment, civil rights, and every industry you can imagine that would have never been possible without money awards to Plaintiffs. We hate the ones who abuse the system, but sometimes you gotta break off a money judgment in someone to really make them "remember" and "change". Personally, I feel the facts of this case do merit a money award. If the City really left this guy on the force despite 18 complaints(and Lord only knows if those complaints are worse or better than what he did here), then perhaps they need to fork over some cash to help them learn not to have people like this on their force. I would be willing to change my opinion if those 18 complaints were all "false".


    But your point is definitely salient, in that many people abuse the system these days.

    He deserves a huge chunk. The cop commited many crimes and violated his civil rights. That cop needs the electric chair for such abuse of power. Who ever thinks a cop can run around and harass people and threaten to "cave Your head in" for the hell of it is clueless. Imagine how many people he has clubbed, maced, and assaulted because he is a loser with a little dick. If we let this shit happen we will have the waffen-ss running in america especially after the new dhs memos to leos. You think I am extreme for asking for extreme punishment, but this is my opinion and I am entitled to it.

    I know that the term 'roid rage was tossed around, but after thinking about this video a bit, I wonder if that isn't exactly that cops problem. Out of curiosity, would a police department include anabolic steroids in their drug tests? Probably not. If the driver's lawyer can force the cop to get a blood test, it's possible he could show that the guy is unstable because of the use of illegal steroids and get him tossed from the department.

    Even if you stop and think that there might be other things going on that got the officer upset, his behavior is so far over the top that he really is a danger to everyone around him.

    making incidents like this to expensive to ignore is a noble venture in my book. the money is jsut a personal bonus.

    The original youtube posters, Ohioans for Concealed Carry, have stated that Canton offered to drop the charges, IF he would agree not to seek civil action. Being as the charges seemed groundless from the onset, seems to be a case of too little, too late...I hope he hammers their collective asses.

    I hate to say it, but that comes close to about 80% of my LEO encounters.....which is why I avoid them like the plague. No idea when the next d-bag with a badge will pop up and make my life a living hell. And yes, 95% of those encounters were here in TX. San Antonio has some real winners.

    Near as troubling is cop #2 fails to man up & tell cop #1 to stop acting like a douche. Anybody can do a "bad cop" youtube search and see that this is the case most of the time. Yea I know 99.9% are swell guys & blah blah blah. If a cop allows another cop to cross the line without intervention, that cop is a douche too.

    If 80% of your police encounters are bad....the cops arent the problem.

    Gotta agree. Have had more'n one stop over the years where I was totally in the wrong. By keeping my cool, being polite and not a smart-ass, what could've been VERY expensive encounters turned into wrist-slaps.

    I believe he is entitled to compensation due to any out of pocket costs he has incurred from this incident, but getting money because a cop blew up on you is a bit much. The taxpayers shouldn't have to pay for someone losing it.

    I also feel both cops should lose their jobs. It is the responsibility of the other cop to uphold order, and his buddy going to that extent is against the law and should not have been tolerated just because he wears a uniform.
