I wouldn't sue them unless I had to. I would ask them to settle for an apology and the officer's resignation.
At least give them a shot to do the right thing before you stick it to them. Too many see these events as a revenue opportunity instead of righting an injustice. Going strictly for money, IMO, speaks loads about someone's integrity.

I hate to say it, but that comes close to about 80% of my LEO encounters.....which is why I avoid them like the plague. No idea when the next d-bag with a badge will pop up and make my life a living hell. And yes, 95% of those encounters were here in TX. San Antonio has some real winners.

this guy is unemployed, i'd be shocked if he doesnt look to get some cash from it
I believe he is entitled to compensation due to any out of pocket costs he has incurred from this incident, but getting money because a cop blew up on you is a bit much. The taxpayers shouldn't have to pay for someone losing it.
I also feel both cops should lose their jobs. It is the responsibility of the other cop to uphold order, and his buddy going to that extent is against the law and should not have been tolerated just because he wears a uniform.
