I bought a handgun over a year ago at an Academy sporting store here in Plano, TX. They did the background check right there over the phone. So now, who knows that I have this particular handgun?
I didn't know of any registration going on, but I've been repeatedly told by friends..."they know...they know".

I also went and got a CHL license. But that didn't involve any info about my particular gun.

    Who knows what?

Academy knows you purchased it and when. The state of Texas and Criminal Justice Agencies have access to records that you have a CHL.

No one knows if you even still have it.

Yes, the CHL doesn't mean I have a particular gun. Actually, they rented handguns to qualify at that class.

But did the store tell anyone that they sold this particular gun to me?

Nobody knows you have that gun, another gun, or any gun. There is absolutely no registration of firearms in Texas and no requirement for any paperwork when selling guns privately.

I used to own many, many guns. But I sold most of them in a garage sale (legal) and lost the rest in a boating accident (tragic). If you catch my drift... ;)

That's what I thought! Everybody is telling me different...friends, people I bump into in stores, etc.

Perhaps they can raid the store's files...maybe they're planning on doing that. What do you think? Would you put that past Eric Holder?

Yeah...I think I'm planning on having a boating accident!

Yes, Red Dawn (the original) was just a movie; the Russians and Cubans haven't parachuted into the central United States.

FFLs only keep hardcopy files of the 4473s, think about many places they would have to "raid" to get them all and then there is the concept that there's no legal requirement for you to have paperwork on a privately-sold firearm.

So relax and don't fall for the hysterics just yet...

    Cheers! M2

Yes they can raid the files and they can come to your house if they see you purchased several guns from that FFL. But like I said, there is no restriction or regulation on private sale of firearms, other than they have to be a TX resident, can't be a felon, etc. All you have to say is you lost/sold all your guns and the burden of proof is now on them.

At this point and time the only record of you ever having that firearm is the original form 4473 that is on file at Academy. If you sell it there is no requirement that you give or get a Bill of Sale. No one is going to come to your door and demand that you register it. If the firearm is used in a crime and recovered, and the serial number is tracked, the manufacturer will show the distributor they sold it to, the distributor will show the dealer they sold it to, and the dealer will show the original form 4473 that shows it was sold to you. They may come ask you about it, but if you sold it the trail ends there. Unless you have a video recorded transaction, and a bill of sale with DNA samples from the buyer, that has been notarized. Quit worrying about something that hasn't and isn't going to happen.

No, but we've got Obama and Eric Holder from within. They've each said that people shouldn't be able to own guns, period. They're going for a piece at a time. I'm just trying to be prepared, which includes knowing what they know.

Maybe they'll have to turn in copies. How are Obama and Holder going to enforce the registration without knowing where the guns are?

Perhaps they'll just pass a law that says if your ever caught with an unregistered gun (e.g., defending your family) you'll receive a felony charge, go to jail, loose your job, etc. That might pull out most of the guns from the good guys.

I'm dead serious. These guys are total control-freak jerks who think we need their divine rule over our lives.

OK, yes. I'm also thinking ahead...they could pass a law that says if your caught with an unregistered gun, you receive a felony charge right there. That's enough to get most good guys to turn over their guns, isn't it?

OK. I just want to make sure. I've been told by so many people that the government knows...that Academy would have reported it, etc.

"I defended myself by wrestling the firearm away from the bad guy and shot him with his own weapon".... end of story

HA, not the 'necks ;) out here! I've been arguing with them since I moved here that there's no TX registration. "But I filled out all that paperwork at the counter". Mind you these are NOT kids nor new gun owners I'm talking about.

Federal law is not enforceable by state or local police.
That helps. But perhaps the feds will make the states have their own gun bans.

Also, the manufacture of crystal meth violates federal law, right? And don't the local and state police bust you if they catch you doing this?

That's what I thought. But everybody I run into disagrees. I believe it's been each and every one without exception!
