    I know a guy that had a possession( grass) and conviction(spent time incarcerated) and as I read the law it says that if there was a deferred adjudication ten years later he could get the chl if It didnt Fall under title 5, Chapter 29, section 25.07, section 30.02..

    My question is can he get the license if there was no deferred adjudication; only if he gets it pardoned or expunged???

    In 1974 we were caught with pot while going to school at NTSU. We were fortunate the law for possession of 1/4 pound and under had just changed to a misdemeanor. We got 6 months probation and deferred adjudication. I latsr joined the military and got a high security clearance.
    I don't know how much your friend had, but I had had a quarter pound and now have a CHL.

    If he was convicted he is not eligible for an expunction. I don't see a pardon mentioned in the Government Code (411(h)), so I don't think that would allow for eligibility either.

    It would appear the question of his eligibility would hinge on the classification of the conviction. Felony or Misdemeanor?

    yeah, felony= no chl or even ownership.
    misdemeanor, gotta wait 5 years. but then there's the utah chl- 3 years wait. or go to az and get a chl, which has reciprocacy.
