    I'm no lawyer, but I wouldn't want to be the one testing the waters with a criminal mischief defense in this case.

    Maybe so but the guy is still a nut bag IMO for shooting anyone over rolling a house.

    Good shoot? Perhaps justified if the homeowner reasonable believed the deadly force was immediately necessary to prevent the imminent commission of criminal mischief at night.

    I cannot see it.
