Throwing this out there, as I'm sure this is not the only person this has happened to...
A friend of the last 7-8 years recently fell on hard times. I bought a pistol from him about 4 months back, and it took him a few weeks to get it to me, but I finally got it.
About 3 weeks ago, he contacted me to buy another pistol, and told me he'd take $200 off if I could send the $ now, and not upon pickup. I agreed, and sent it thru PayPal as a "transfer" and not a purchase, since that's what 'friends' do, right... The PayPal transfer does indicate what the purchase was for, along with other documentation.
Anyway, he has not been able to bring me the gun, despite numerous 'promises' to do such via text message, email, Google Chat, etc. Also promised to refund the $ utnil I got the gun. That was last contact.
Recently this 'friend' has gone dark, and I keep texting and calling, to no avail. Not sure what the deal is, but my wife is furious as the pistol was not cheap, and this person refuses to acknowledge me any longer.
Since I have the agreement of purchase and agreement to refund monies in writing, is this possible to pursue in Small Claims Court? I hate to do this which would ruin said 'friendship' but at this point it's just ridiculous to keep jerking me around in this matter, and I'm done arguing with him about it.
What would you do, and what are possible options I have, if any? Thanks in advance!
