    Loop hole was what the news used, i was only stateing that I'm glad Texas is on their bad list. I believe they were calling texas lack of a background check for private firearms sales a loophole to buy a gun without a call to the feds.

    I realize that they used the term loophole. I was just clarifying that there are no loopholes. We (Texas) have no authority to override Federal Law and we Texans must follow all Federal Laws.

    The purpose of the bill of sale is to protect YOU if the firearm is subsequently used in the commission of a crime. The bill of sale will show that the firearm is no longer your property or in your possession.
    It does no such thing. Unless it is notarized it is just a ppiece of paper.
    This is important if you bought the firearm from a dealer and you had paperwork filled out and a background check done on you which would tie the weapon to you.
    So what of you are "tied to the weapon". Unless the police have reason to suspect you of a crime all they are going to do is ask you if you still have the firearm. You tell them you sold it and that's the end of that.

    Why create defacto registration?

    Fella who asked how to complete a legal and private sale; to protect yourself, print a copy of a firearms bill of sale from BUY SELL TRADE GUNS ONLINE. TEXAS GUN SHOW | CLASSIFIEDS | AUCTIONS and have the buyer fill out the form. If they are hesitant to put their DL number and other info on the form, it might be a good idea to back out. The purpose of the bill of sale is to protect YOU if the firearm is subsequently used in the commission of a crime.     I myself will NEVER give personal info to a complete stranger.

    How does it do that? I can make up phony Bill of Sale all day long. Even if it is notarized like TXI says, if it shows up a a crime scene and video has me holding it, that BOS is toilet paper.


    Reality is it provides no protection at all. At most, it could help the Police in an investigation but that is all.

    Keeping records of who owns/sells guns is gun registration. Just because it is not Fed/State mandated does not change that.

    Minor correction. We must only follow Federal law where Federal law has jurisdiction and is legally conceived...not ALL Federal laws.

    As far as I'm concerned, screw the Feds, and the pink unicorn they rode in on too.

    Im not filling crap out for a private sale, hell half the time it's some weirdo you met on the Internet 15 minutes ago. If its a stranger you'll be lucky if the guy doesn't come find your house and steal the gun you bought from him.

    I really had this question (not to hijack this thread) but any solid way of purchasing a firearm online from a person without getting into trouble since there is no way to know the history of a firearm. What if its stolen or you know what I mean.

    What if it is is stolen? You run the risk of having it confiscated by LE at some point if the ever run the serial.

    Well damn, had my dad get a couple run for me that were coming from a questionable seller, but he still has friends from his LE days, didn't realize it would be hard getting them to run it, strange seeing as they could get a lead on stolen weapons.

    Who is gonna know? I have bought tens of thousands of items (guns, tvs, cds, microwave, iphone, etc.) over the years and unless the PD runs the SN on them, nobody knows if they are stolen. It is one of those things you really should not worry about. Use common sense when buying, but after that, forget about. The good news is very few firearms are stolen. Heck maybe this computer I am using is stolen.

    Craigslist is full of those stolen electronic sellers. I have no experience with buying guns from individual online or even FTF.

    Unless someone has an FFL he has no business asking for your personal information when selling a firearm. Period. If someone asks for a bill of sale he is telling you he is a loser and he has no idea what he's talking about.

    I think a good compromise for the weanies out there on FTF is just to ask to see CHL to verify legality, but retain nothing. Just ask 'em to flash their CHL badge

    Personally, when I've sold stuff in the past I never went past asking someone if they were legal. Of course if they looked like a super-thug or like they're 15 I would just walk. Its your perogative to buy and to sell based on YOUR criteria (within the law).

    Yet another area the gov should stay out of the free market, you know "shall not be infringed" and all.

    If they want to tolerate what many see as excessive and un-Constitutional laws and regulations, that's great for them. They can have their socialist workers paradise along with the repressive and intrusive government that goes along with it.

    But, leave us the Hell alone. Don't press for some new damned Federal Law that will infringe on our rights and freedoms!

    Another reason that I believe it's ineviteable that we will end up in a much different looking and functioning North America in the future.
