    What really caught my eye in the story was that the man sitting in the passenger seat was arrested for public intoxication. I did not know that a person could be arrested for sitting in the car while being driven home.

    Maybe someone more well-versed in the law could shed light on this.

    "SAN ANTONIO -- A four-year veteran with the San Antonio Police Department was arrested overnight and charged with DWI.

    Officer Robert Romo, 26, has been placed on administrative leave.

    Police Chief William McManus divulged details of the arrest at a press conference on Friday morning.

    He said officers stopped a vehicle they had observed using the shoulder to pass another vehicle on San Pedro at Loop 410 around 2 a.m. Friday.

    The occupants of the vehicle did not immediately wind down their window. When they finally did, officers observed a man in the passenger's seat and a man in the back seat -- nobody was in the driver's seat.

    McManus said it was later determined that Romo had climbed to the back seat after he was pulled over.

    Both men smelled strongly of alcohol and failed an alcohol breath test.

    Romo was arrested and charged with DWI. He was booked at the Bexar County Jail on a $1,600 bond.

    The passenger was charged with public intoxication.

    McManus said Romo had been on injury leave, although the details of his injury were not known. He had served at the department's central precinct."
